Vattel, who Madison relied on heavily throughout his life, made this distinction. A nation-state has a right to grant jus soli citizenship, as did Virginia and Britain at the time at the time the Constitution was adopted. But <i>jus soli</i> citizenship is not the same as natural-born citizenship. It is a form of naturalization at birth.
