Taitz loses

Orly Taitz

In case you haven’t been reading the comments here, Orly Taitz has lost her application for an emergency stay of execution (err, sorry, first things first) sanctions. She’ll have to cough up the $20,000. In a report at TPM Muckraker, Taitz is reported to have blamed this on Supreme Court clerks, believing that no judge actually saw it.

She cited a passage from a book co-authored by Justice Antonin Scalia in which, she claimed, Scalia said that less than one percent of cases are actually read by a judge.

I could believe that. Taitz is also reported as saying that she will pay the $20,000 before giving President Obama the satisfaction of taking her house. I think her family will agree with that decision.

    With this latest news I suspect that her donations will increase dramatically. That was claimed that she has gotten $3,305 in donations “from August 9”, but she doesn’t realize that the amount generally tails off. Not only is she the Queen Birther but also a Drama Queen.

This person posing the question on wells mentioned that all recent presidential candidates spent similar amounts of legal bills so he asked how do they know Obama’s was for hiding records.     Yes, check Dr. C’s archives, he covered this. A quick review, Of all the birther cases only 2 suits named Obama (the rest were against State sec of states or state officials) The amounts spent on this were minimal. Just reseach Doc’s older archives. In both of the suits with Obama named, court cost were awarded in favor of Obama. If it’s Birther Stuff, it’s BS.

    Truth Matters, it seems that da verg fail Mathematics.

    – I must look up the lawyers that represented Obama.
    – Then I determine the firms that those lawyers work for.
    – I now look at the amount Obama is paying to those firms.
    – Now it is possible to isolate those firms legal fees were paid to.
    – I know the time they spent on the cases.

    The equations of his argument is ”(hours)x(rates) ? (bills).” They don’t know how many hours that Obama’s lawyers spent on the various suits by birthers, as it is next to impossible to separate out the hours spent.

    If we look at one case where birthers had to pay Obama’s legal fee it was about $20. Let us make it $21 dollars, and given them all the 71 cases.

    21 x 71 = 1420 + 71 = $1,520.

    And of course the President didn’t produce a certified true copy. That’s what states do. And that’s what the legal authority of the state of Hawaii did. Ask a birther to produce his driver’s license and then prove to you it’s not a forgery. Post it on the ‘net for all to examine? Not good enough. Where’s the hologram? Why doesn’t it look like your driver’s license? Get a verification letter from the state? Not good enough. It’s a lie or a forgery.

    Birthers have never been interested in the truth and never will be. That’s why they keep moving the goalposts. Their endgame is to delegitimize the legally elected President anyway possible even if it means lying or deliberately spreading misinformation. It’s un-American, cowardly and completely disrespectful of the Constitution and U.S. laws and not very far from outright espionage, sedition or treason.

    What I meant to say was, you are making them to live to a high standard, and forcing them to be more rational. This will not change their perception, but make them to look at the big picture.

    It is not over quite yet. Taitz says that she is now petitioning for certiorari. A cert petition would have been the only appropriate form of appeal. Even if Taitz’s appeal had merit, the appropriate remedy for dealing with a sanctions order and civil judgment is to simply quash that judgment; there is no harm from quashing that judgment whilst an appeal is pending.

    Taitz did request an outright reversal of the lower court decision in her stay application in addition to mere stay of the sanctions order. This request for outright reversal went beyond anything that can be accomplished from a stay application, as reversal requires petitioning for certiorari. Some of the relief that Taitz requested in her stay application would be incapable of being granted in the event that she successfully petitioned for certiorari and overturned the lower court’s ruling; as Rhodes chose not to appeal the dismissal of her claim, Taitz is only entitled to appeal the issue of sanctions.

    It is only when Taitz’s cert petition is denied that we can say that Taitz has no option left but to pay the damn fine. This will happen in due course, when Taitz’s case will be among the many others listed in an order headed “Certiorari Denied”. (Unlike Taitz’s petition, many of the appeals listed in the order will have presented compelling legal questions that sadly failed to make the cut.) Of course, Taitz will complain once again that the order is not signed by the justices; her anger is not so much about the treatment of her case in particular as the entire judiciary and its rules and procedures.

    Hi Bill. Someone posted your comment over at ObamaConspiracy.org. I don’t know if you were referring to me or not, but in case you were, I’ll reply.

    I’m old enough to remember the 1950’s when you could get some traction calling someone a communist, but today? Communism is ancient history. You need to use something trendy like “jihadist.” However, I am none of those; I’m a Lutheran, and most to be feared.

    And those millions of dollars you think Obama spent getting a few motions to dismiss written are, of course, being paid to folks like me to reimburse me for my $8 a month web hosting account.

    After watching 70+ Obama eligibility lawsuits wash under the bridge, I can assure you that the Lakin case gets attention because it’s only game in town. The only question at stake in the Lakin trial is whether the Army makes an example of him, or is lenient in recognition of his 17 years of service. My guess is the latter.

I did, however, forward copies of Orly’s posts re: the use of pig’s blood/piglets to intimidate and terrorize those at the Muslim community center and my email to her and her response to the Anti Defamation League and challenged them to call out one of their own for the hate speech she is propogating. I then forwarded everything to Rachel Maddow and Huff Po. Don’t know if it will do any good, but at least I tried.

    Not that surprising. Taitz has always allowed disagreeing comments that she thinks reflect badly on the disagree-ers. And that comment is mostly invective, over-the-top: “burn in hell”, and even vaguely threatening: “personally escourt you to the firing wall.” Taitz particularly favors comments that are vaguely threatening.

    What is new in the past few months is the appearance of comments that are in reasonable disagreement with her. In the past such comments never made it through moderation.

BE WARNED: The outcome of that “national trial” will dictate whether or not there will be civil war.     As you may know, Ma’am, the case of Lt.Col. Lakin, MD is being closely watched by a very large portion of the general public. What he has done, to date, is NOT out of any intentional disrespect towards his immediate chain of command. Far from it, but towards his fidelity as an officer, to defend & protect the U.S. Constitution, which is the highest calling, and as such, should be respected, with honor. I know that there are MANY in the command structure that would disagree with that opinion, but many of us veterans do see it that way, as does a growing segment of the general population. Particularly given, the man’s service record, and the honors that have already been bestowed upon him.

    I’m am sure that you are well versed on the federal courts’ short-shift of the eligibility issue in their courts, and we are all well aware of the political pressures that you, as the CIC, must be under. However, we are looking to the military, in this case, and your command specifically, to do justice to the U.S. Constitution and the general citizenry, to which the Army has sworn to protect, from “all enemies, foreign & domestic.” The court martial of Lt.Col. Lakin, like it or not, will be a “defining event in American History.” Blind loyalty, to the office of President of the United States, will no longer suffice to quell the growing civil unrest, that is now occurring, due to this issue of concealed eligibility. It cannot be ignored nor swept under the rug any longer.

    Had unscrupulous & dishonest politics not prevailed already, in the civilian federal courts, concerning the issue of standing, this issue of eligibility would not now be on your military doorstep. In essence, there would not now even be a court martial to deal with.

    Many of us see this court martial. as the LAST attempt, that “we” (as citizens) will have, in lawfully uncovering the truth of the matter, in the hopes that an honorable showing of “the rule of law,” by a properly authorized court of law, can still prevail concerning this issue. Lt.Col. Lakin has intentionally placed himself in harms ways, due to the eligibility issue, in order to PROVE standing, as defined under the law, to force the issue to uncover the truth, by a lawful & full discovery. That is about as “Courageous” as it gets! And shows an exemplary degree of honor towards his service to the nation. If this does not happen, I fear that there will be dire consequences, in regards to the domestic tranquility in the aftermath.

    My own feeling is that all the rumors about fakes are based on paranoid assumption and left-wing talking points designed to make us give up hope of an eventual resolution. The King has no clothes.

    1. Have you ever seen things like cold case files and other history channel stuff on TV? The lab forensics they have is unbelieveble. I don;t think they could fake anything that would stand up. I don;t think anyone could. And for them, it’s real treason, while right now Obama could always say it’s what his mamma told him and all that.

    No, I think Obama is wide open on this, Pamela.     “Amendment X is unconstitutional” and has never been tested in court.” Where “X” is 14, 16, 17, or 18.

    Typical example: Amendment 17 somehow denies the states the right to a Republican government (I don’t know of any with a monarch or a theocracy, do you?). Or 18 was obviously unconstitutional, that’s why we needed an Amendment 21 to repeal it (if it was unconstitutional, why did it take a constitutional amendment to repeal it).

    Of course it ignores the fact that an amendment by definition can’t be unconstitutional, since it’s whole point is to change the constitution. Quite simply, you can make something that was once unconstitional constitutional by an amendment.

    It seem someone got lost in their own argument. Amendments change the constitution. An Amendment can make something constitution. Later that Amendment can be repealed or superseded. … and that is just a simple example.

    One guy went so far as to say that something in the Constitution was against the Declaration of Independence, so it couldn’t possibly be Constitutional?!?!?

    I believe they also conflate the word ‘republican’ in A4S4 to mean the Republican party. As in The United States shall guarantee to every state in this union a republican party form of government.

    One could say the same about the NBC clause. It has never been tested in court (except perhaps in the Ankeny case). It violates equal protection (and common sense) by making 2 classes of citizens, even if only for the limited purposes of Presidential eligibility.

    So, the NBC clause might, in fact, be unconstitutional!

    However, I checked how that wall in Auschwitz that is on so many blogs as “firing wall” is officially called in Polish. It is Å›ciana straceÅ„ (hoping the first and last letter come through correctly so people can google it) – the wall of death, but that word for death (there are more in Polish) often implies execution, so wall of execution would be correct as well. No idea why so many are turning it into firing wall. Perhaps a translator pushed that term and the guides at Auschwitz are always using it when talking to English-speaking tourists.

    People with the appropriate h/w (http://www.sun.com/bigadmin/hcl/) & necessary skill to administer a Unix system should check out OpenSolaris (http://www.genunix.org/distributions/indiana/osol-dev-134-x86.iso for the latest release) or at least a Linux system instead of running a Windows system on their bare metal. This allows you to have the security of a Unix system & Firefox as the default Internet browser. If you still need Windows things you can install VirtualBox virtualization s/w (http://download.virtualbox.org/virtualbox/3.2.8/ for the latest version) & then add Windows. These are all free. With a Unix system you won’t need to worry about Orly’s webmaster’s inadequacies or the script kiddies.

    PS: Mac OSX is a Unix system. There is also a version of VirtualBox available for OSX Server.
