Taitz loses

Orly Taitz

In case you haven’t been reading the comments here, Orly Taitz has lost her application for an emergency stay of execution (err, sorry, first things first) sanctions. She’ll have to cough up the $20,000. In a report at TPM Muckraker, Taitz is reported to have blamed this on Supreme Court clerks, believing that no judge actually saw it.

She cited a passage from a book co-authored by Justice Antonin Scalia in which, she claimed, Scalia said that less than one percent of cases are actually read by a judge.

I could believe that. Taitz is also reported as saying that she will pay the $20,000 before giving President Obama the satisfaction of taking her house. I think her family will agree with that decision.

Obama is going to take away her house.

“Get out!” he’ll say, “This is MY house now.”

Michelle will go through her closet and see what she wants to keep and what she wants to throw away.

Gonna have to do something to get that borscht smell out of the walls.

Quite a change from last October:

Taitz said she had absolutely no plans to pay the $20,000 fine.

“Are you kidding? Of course not,” she said,

With this latest news I suspect that her donations will increase dramatically. That was claimed that she has gotten $3,305 in donations “from August 9”, but she doesn’t realize that the amount generally tails off. Not only is she the Queen Birther but also a Drama Queen.

Got a question folks: Someone on citizenwells blog posted a question to everyone there asking about the supposed millions Obama spent “hiding records” (that’s the most prevalent birther Myth it seems and it would be a good point to focus on debunking that one to the birthers .. This person posing the question on wells mentioned that all recent presidential candidates spent similar amounts of legal bills so he asked how do they know Obama’s was for hiding records. The question is: how do we know the Obama legal bills were for hiding records?

    >>>look at the lawyers names who show up in court to represent OBAMA
look at the firm(s) they work for

look at the specialty of the firm

look at public records showing obama paying the firm and amount they paid

this is all been researched, there is no denying the amounts of money involved, the firms hired, their area of expertise, the time they spent
on the cases. It is a simple matter of multipling hours spent by billable rates and looking at obama’s own bills to the firms. He can’t hide this information, it has been researched

Yes, check Dr. C’s archives, he covered this. A quick review, Of all the birther cases only 2 suits named Obama (the rest were against State sec of states or state officials) The amounts spent on this were minimal. Just reseach Doc’s older archives. In both of the suits with Obama named, court cost were awarded in favor of Obama. If it’s Birther Stuff, it’s BS.

  15. avatar
    richCares August 17, 2010 at 12:27 am #

I put “cost millions” in Doc’s search prompt, the first result was:
“The monetary cost to the government in defending these … cases was extremely minimal”
    http://www.obamaconspiracy.org/?s=cost+millions
    .
there are more examples, howver correcting birthers never works, hating Obama causes brain damage. You can’t argue with a f o o l.

Here’s an interesting article on the subject:

    What’s Obama’s Birther Legal Bill?

Activists charge that Obama has spent millions to silence them in court. Not exactly, say the government’s lawyers.

Truth Matters, it seems that da verg fail Mathematics.

[translation of de verg’s brain waves (train of thought)]
    – I must look up the lawyers that represented Obama.
    – Then I determine the firms that those lawyers work for.
    – I now look at the amount Obama is paying to those firms.
    – Now it is possible to isolate those firms legal fees were paid to.
    – I know the time they spent on the cases.

[quoting da verg] It is a simple matter of multipling hours spent by billable rates and looking at obama’s own bills to the firms.

The equations of his argument is ”(hours)x(rates) ? (bills).” They don’t know how many hours that Obama’s lawyers spent on the various suits by birthers, as it is next to impossible to separate out the hours spent.

If we look at one case where birthers had to pay Obama’s legal fee it was about $20. Let us make it $21 dollars, and given them all the 71 cases.

    21 x 71 = 1420 + 71 = $1,520.

There are others who will give more useful information.

Below is a link of a discussion on this same topic from Dec 29, 2009.

Let’s cut to the chase and stick with the absolute FACTS:
    1. Obama sealed ALL his records in life from Day 1 in Office.
    2. Obama has NEVER produced a certified true copy of his Birth Cert.
    3. Obama has something to hide and he is hiding everything about his life.
What more do we need to fool ourselves? Law suits? Counting beans – how much he spent on legal fees? How much he disrespects his country (most likely not) and his fellow country men/women (most likely not) to even play games in such a manner with us?

Let’s don’t waste any more of our energy and precious time by questioning eachother like how much money he spent or not spent on the damn law suits. The fact that we the people, his employers, have to SUE him to see if he is qualified or not is just twisted and sickening. IMO.”

    ^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^

So here is the translated logic of a birther; “Why waste energy on worrying about if one of our statements is false or not” We don’t need to be distracted with the validity of any of our claims, so long as our most important claims are right!

Except I decided to focus on his #1 claim that Obama sealed all his life records by pointing out that Obama’s executive order #13489 only seals presidential records
    http://fas.org/sgp/obama/presidential.html

and is the SAME as Ronald Reagan’s executive order #12667
    http://www.archives.gov/federal-register/codification/executive-order/12667.html

    …..

I’m still pretending to be “one of them” but I imagine my un-moderated ability to post there won’t be lasting too much longer because they’ll figure out if I was really one of them I wouldn’t be so pre-occupied with trivial things like the **factual accuracy of birther claims.**

In fact Obama increased access to presidential records by revoking the Bush order 13233 and restoring things to the state of the Reagan administration (order 12667).

Here is another rundown of the Presidential Order in question:
    http://historycoalition.org/2009/01/21/president-obama-revokes-bush-presidential-records-executive-order/

And of course the President didn’t produce a certified true copy. That’s what states do. And that’s what the legal authority of the state of Hawaii did. Ask a birther to produce his driver’s license and then prove to you it’s not a forgery. Post it on the ‘net for all to examine? Not good enough. Where’s the hologram? Why doesn’t it look like your driver’s license? Get a verification letter from the state? Not good enough. It’s a lie or a forgery.

Birthers have never been interested in the truth and never will be. That’s why they keep moving the goalposts. Their endgame is to delegitimize the legally elected President anyway possible even if it means lying or deliberately spreading misinformation. It’s un-American, cowardly and completely disrespectful of the Constitution and U.S. laws and not very far from outright espionage, sedition or treason.

    1. Social Security survivor’s benefits between the ages of 14 and 21, due to my father dropping dead outside my bedroom door one fine spring morning.

    2. Tax refunds between the ages of 24, when I got my first job, and the present.

It is not over quite yet. Taitz says that she is now petitioning for certiorari. A cert petition would have been the only appropriate form of appeal. Even if Taitz’s appeal had merit, the appropriate remedy for dealing with a sanctions order and civil judgment is to simply quash that judgment; there is no harm from quashing that judgment whilst an appeal is pending.

Taitz did request an outright reversal of the lower court decision in her stay application in addition to mere stay of the sanctions order. This request for outright reversal went beyond anything that can be accomplished from a stay application, as reversal requires petitioning for certiorari. Some of the relief that Taitz requested in her stay application would be incapable of being granted in the event that she successfully petitioned for certiorari and overturned the lower court’s ruling; as Rhodes chose not to appeal the dismissal of her claim, Taitz is only entitled to appeal the issue of sanctions.

It is only when Taitz’s cert petition is denied that we can say that Taitz has no option left but to pay the damn fine. This will happen in due course, when Taitz’s case will be among the many others listed in an order headed “Certiorari Denied”. (Unlike Taitz’s petition, many of the appeals listed in the order will have presented compelling legal questions that sadly failed to make the cut.) Of course, Taitz will complain once again that the order is not signed by the justices; her anger is not so much about the treatment of her case in particular as the entire judiciary and its rules and procedures.

A famous quote by George Washington….Orly needs to read this founding father…

“It is now no more that toleration is spoken of, as if it was by the indulgence of one class of people, that another enjoyed the exercise of their inherent natural rights. For happily the Government of the United States, which gives to bigotry no sanction, to persecution no assistance requires only that they who live under its protection should demean themselves as good citizens, in giving it on all occasions their effectual support. ”

I’m old enough to remember the 1950’s when you could get some traction calling someone a communist, but today? Communism is ancient history. You need to use something trendy like “jihadist.” However, I am none of those; I’m a Lutheran, and most to be feared.

And those millions of dollars you think Obama spent getting a few motions to dismiss written are, of course, being paid to folks like me to reimburse me for my $8 a month web hosting account.

After watching 70+ Obama eligibility lawsuits wash under the bridge, I can assure you that the Lakin case gets attention because it’s only game in town. The only question at stake in the Lakin trial is whether the Army makes an example of him, or is lenient in recognition of his 17 years of service. My guess is the latter.

To bad all you folks are not Texans. We’re fed up with this British President, that has camped out in our Oval Office, dragging us down the road to Marxist socialism. So we have talked our Governor Rick Perry into taking our Texas out of this mess in Washington. When we signed up we left ourselves an out. We can succeed from the Union any time we feel Texas would be better off by our selves. We have the Oil, Gas and Houston Ground Control. Once outside of an amended Constitution we can again own slaves, **** we got enough Illegal Aliens to get that ball rolling from the get go. http://www.beacononlinenews.com/news/daily/1640

Now that we know that Obama has corrupted every court so they won’t hear your cases on the merits, Orly, I think you should appeal this latest fiasco to a court that certainly will hear your case.

There is a pastor in Harlem who was able to obtain a conviction against Obama in a case that was sanctioned by the 10th Amendment. I don’t know whether you have heard of him. His name is James David Manning. He’s all over Youtube.

Maybe you can get this judge to hear your case on the merits? He suggests that the results of his Obama trial will be taken up by Congress any day now and the Usurper will be led away from the White House in shackles along with his wife and children.

Not that surprising. Taitz has always allowed disagreeing comments that she thinks reflect badly on the disagree-ers. And that comment is mostly invective, over-the-top: “burn in hell”, and even vaguely threatening: “personally escourt you to the firing wall.” Taitz particularly favors comments that are vaguely threatening.

What is new in the past few months is the appearance of comments that are in reasonable disagreement with her. In the past such comments never made it through moderation.

One never knows what that comment meant. It could be what it appears on face value, it could be a troll just trying to start a flame war, it could be someone playing with Orly’s paranoia, or it could be an Orly supporter trying to discredit Orly’s opponents. Certainly such remarks universally work in Orly’s favor as for as public opinion goes, demonstrating that her opponents are foul-mouthed, mean spirited, violent, anti-Semitic and vindictive.

That phrase, “firing wall” is extremely unusual in American usage. We would say “up against the wall” or “firing squad.” I understand that there is a Spanish phrase that translates “firing wall.” The other source in English is a memorial at Auschwitz.

    From Resistnet…

    Supreme Court upholds ‘birther’ sanction
    – 8/16/2010 2:26:18 PM

The Supreme Court has upheld a $20,000 fine against a leader of the movement challenging President Barack Obama’s citizenship.

The high court on Monday refused to block a federal judge’s October 2009 ruling that required California lawyer and dentist Orly Taitz to pay the
$20,000 fine for filing a “frivolous” litigation. The judge said Taitz
attempted to misuse the federal courts to push a political agenda.

The individual states should not allow that ninnie in the White House to put his name on the 2012 presidential ballot until he shows proof of citizenship. In the meantime, we need to flip that toilet they call the House of Representatives and flush all his co-conspirators out to the septic tank where they belong. I know Arizona would, and after this administration basically told the citizens of the great state of Missouri to go scratch after the health care referendum, they would follow suit. We just need a handfull of states to throw a wrench in the works with the 10th Ammendment as the reason. Can you imagine the look on George Soros’ face and the faces of his fraternity of Neo-Progressive elitists that have this country in a death grip. There would be a turd blizzard the likes of which has never been seen in politics to date.

Nobody can “order you” into any specified outcome, with a plea of “We must prevent a Constitutional crisis!” BECAUSE, one already exists!! It cannot be ignored any longer. We expect the military to do it’s duty to the nation, declaring the usurpation of the presidency, and all of the accomplishes to this crime, as a wilful act of treason against the citizens of the United States. Therefore, to act accordingly and to presume a course of action, to restore civil order and a lawfully interim government. Its purpose, to restore the absolute rule of law and the U.S. Constitution. HONOR MUST BE RESTORED TO AMERICA!!

    ————————————————

    Maj. Gen. Carla Hawley-Bowland,

As you may know, Ma’am, the case of Lt.Col. Lakin, MD is being closely watched by a very large portion of the general public. What he has done, to date, is NOT out of any intentional disrespect towards his immediate chain of command. Far from it, but towards his fidelity as an officer, to defend & protect the U.S. Constitution, which is the highest calling, and as such, should be respected, with honor. I know that there are MANY in the command structure that would disagree with that opinion, but many of us veterans do see it that way, as does a growing segment of the general population. Particularly given, the man’s service record, and the honors that have already been bestowed upon him.

I’m am sure that you are well versed on the federal courts’ short-shift of the eligibility issue in their courts, and we are all well aware of the political pressures that you, as the CIC, must be under. However, we are looking to the military, in this case, and your command specifically, to do justice to the U.S. Constitution and the general citizenry, to which the Army has sworn to protect, from “all enemies, foreign & domestic.” The court martial of Lt.Col. Lakin, like it or not, will be a “defining event in American History.” Blind loyalty, to the office of President of the United States, will no longer suffice to quell the growing civil unrest, that is now occurring, due to this issue of concealed eligibility. It cannot be ignored nor swept under the rug any longer.

Had unscrupulous & dishonest politics not prevailed already, in the civilian federal courts, concerning the issue of standing, this issue of eligibility would not now be on your military doorstep. In essence, there would not now even be a court martial to deal with.

Many of us see this court martial. as the LAST attempt, that “we” (as citizens) will have, in lawfully uncovering the truth of the matter, in the hopes that an honorable showing of “the rule of law,” by a properly authorized court of law, can still prevail concerning this issue. Lt.Col. Lakin has intentionally placed himself in harms ways, due to the eligibility issue, in order to PROVE standing, as defined under the law, to force the issue to uncover the truth, by a lawful & full discovery. That is about as “Courageous” as it gets! And shows an exemplary degree of honor towards his service to the nation. If this does not happen, I fear that there will be dire consequences, in regards to the domestic tranquility in the aftermath.

“Though the heavens may fall, let justice be done.”

Thank you for your time Ma’am,

    Pamela,

My own feeling is that all the rumors about fakes are based on paranoid assumption and left-wing talking points designed to make us give up hope of an eventual resolution. The King has no clothes.

    1. Have you ever seen things like cold case files and other history channel stuff on TV? The lab forensics they have is unbelieveble. I don;t think they could fake anything that would stand up. I don;t think anyone could. And for them, it’s real treason, while right now Obama could always say it’s what his mamma told him and all that.

    2. I think if they could have they would have, by now.

No, I think Obama is wide open on this, Pamela. The Globe clearly means business running three front-page headlines on this every other week and people are really starting to talk about this thing seriously since the first time it started (well, okay, Dobbs was talking about it seriously, but Dobbs wasn’t saying it to millions of people in supermarkets everyday the way the Globe is, and some of those people in the supermarkets are going to REMEMBER what they saw on Dobbs’ show and tell their friends.)

I don’t care what the SCOTUS says today. I’m waiting to see what they say when public pressure goes up. Or they may have nothing to do with it at all: public pressure may very well force Obama’s extremely weak hand, or the dems may regard him as such a liability if this thing grows that they do to him what they’re doing to Rangle, cut their losses and tell him to get lost, or the congress may decide once the GOP is in control that they want answers and they’re not going to fool around when it comes to getting them. Despite the SCOTUS ruling, this situation has actually never looked better.

Reply by James Gragg 1 day ago
The only realistic means to achieve the replacement of SCOTUS, will NOT happen by any “impeachment” hearings. The only real practicable means to do it, will not happen without “bloodshed.” THAT is the “political reality.”

“Therefore, to act accordingly and to presume a course of action, to restore civil order and a lawfully interim government. ”

How exactly would any kind of ‘interim’ government be lawful? These folks are willing to burn the Constitution up, in order to save the Constitution.

Yes. They are. They even say it in so many words in many arguments I have had with them lately. They are constantly repeating the mantra

“Amendment X is unconstitutional” and has never been tested in court.” Where “X” is 14, 16, 17, or 18.

Typical example: Amendment 17 somehow denies the states the right to a Republican government (I don’t know of any with a monarch or a theocracy, do you?). Or 18 was obviously unconstitutional, that’s why we needed an Amendment 21 to repeal it (if it was unconstitutional, why did it take a constitutional amendment to repeal it).

    Crazy is as Crazy does.

Of course it ignores the fact that an amendment by definition can’t be unconstitutional, since it’s whole point is to change the constitution. Quite simply, you can make something that was once unconstitional constitutional by an amendment.

Wait- you are ignoring how the Preamble supercedes everything else in the Constitution! Don’t tell me that you forgot that fine argument.

It seem someone got lost in their own argument. Amendments change the constitution. An Amendment can make something constitution. Later that Amendment can be repealed or superseded. … and that is just a simple example.

One guy went so far as to say that something in the Constitution was against the Declaration of Independence, so it couldn’t possibly be Constitutional?!?!?

I believe they also conflate the word ‘republican’ in A4S4 to mean the Republican party. As in The United States shall guarantee to every state in this union a republican party form of government.

    Really, really, weird.

One could say the same about the NBC clause. It has never been tested in court (except perhaps in the Ankeny case). It violates equal protection (and common sense) by making 2 classes of citizens, even if only for the limited purposes of Presidential eligibility.

So, the NBC clause might, in fact, be unconstitutional!

The problem isthat Orly’s site is a bloody mess and her front page is now so buggered up its lost its “go back a page” link.

This of course will be blamed on Obot hackers, Obama, Secret Service, I’m being persecuted, USURPER……send me money

Dr. Conspiracy: That phrase, “firing wall” is extremely unusual in American usage. We would say “up against the wall” or “firing squad.” I understand that there is a Spanish phrase that translates “firing wall.” The other source in English is a memorial at Auschwitz.

I also noticed that last one – somehow, the fact that she does not relaize either (if she’s genuine) that Jewish Moldovain may be interpreted as anti-semite also suggests the possibility she’s Polish-American, but born and bred in America.

However, I checked how that wall in Auschwitz that is on so many blogs as “firing wall” is officially called in Polish. It is ściana straceń (hoping the first and last letter come through correctly so people can google it) – the wall of death, but that word for death (there are more in Polish) often implies execution, so wall of execution would be correct as well. No idea why so many are turning it into firing wall. Perhaps a translator pushed that term and the guides at Auschwitz are always using it when talking to English-speaking tourists.

People with the appropriate h/w (http://www.sun.com/bigadmin/hcl/) & necessary skill to administer a Unix system should check out OpenSolaris (http://www.genunix.org/distributions/indiana/osol-dev-134-x86.iso for the latest release) or at least a Linux system instead of running a Windows system on their bare metal. This allows you to have the security of a Unix system & Firefox as the default Internet browser. If you still need Windows things you can install VirtualBox virtualization s/w (http://download.virtualbox.org/virtualbox/3.2.8/ for the latest version) & then add Windows. These are all free. With a Unix system you won’t need to worry about Orly’s webmaster’s inadequacies or the script kiddies.
