Waiting for Arpaio

It’s 5:17 PM on February 28, and since this is leap year, we will have to wait an extra day for Joe Arpaio’s March 1st press conference announcing to the world what he supposedly already told Rick Santorum about what his “cold case posse” found out regarding the veracity of allegations that Jerome Corsi and a band of Tea Party petitioners presented to him. [Sorry about the long sentence1.]

So I have my life on hold for another day. In fact today I have been reduced to reading scholarly journals. That’s a sarcastic way of saying that a slow news day is a good thing from time to time.

I have pondered the question of what Joe Arpaio will say. I don’t figure that he will add anything new to the store of information about Barack Obama. The open question is just how, or whether, he will spin it.

    A word of advice, sell your frogs quickly, there will be no frog marching on March 1. I talked to Sheriff Joe’s youngest son’s brother’s first wife who said “He ain’t got nothing, no how”. Birferstani’s will say he sold out. Birferstani’s actually believe he found something that the mainstream media could not. The unknown secret of Obama’s birth in Jamaica is still safe.     Fogbow members have obtained several new briefs filed by President Obama’s lawyer in the Pennsylvania ballot challenge cases, set to be heard the same day, March 1, at 10 a.m.

    The lawyer is John Lavelle, and his stuff is GOOD. They’re not even letting Mario Apuzzo’s application for pro hac vice go unopposed. Why should Mario be admitted to this case, when he’s making the exact same legal arguments that were ruled FRIVOLOUS by the Third Circuit Court of Appeals?

    And the birthers want to have some unnamed witness call in to the court from Arizona on Skype, but Lavelle is having none of it.

    This one isn’t going to be Birthers v. an Empty Chair. Apuzzo and Kerchner are going to be heading into the wood-chipper, it looks like from where I sit. :mrgreen:

    I’m trying to see how anything Arpaio could say would help one Republlican vs another. Frankly, at this point, the Republican candidates are so abysmal that even if Joe declares Obama guilty of 23 crimes and issues a warrant for his arrest, he would still be favored to win. It might even help him win Arizona if Sherriff Joe.picks a fight with him.

    Agreed. That is why I my expectations for the Joe Arpaio show have always been along the lines of what J Potter just mentioned. Of course, who knows what kind of spin and stunt he’ll try to pull. So, I’ll just sit back and be as surprised by whatever spectacle goes down in two days as everyone else.

    You Obots don’t seem to understand there are two OMG moments on March 1, first there is the explosive Sheriff Joe report, then the PA ballot challenge where Berg digs a hole for the Kenyan born Obama. These occur on the same day, do you understand that, the same day. Biferstan has never had 2 OMG moments on the same day, so it is important. After this Berg will be named president of Biferstan with Sheriff Joe as his attorney general (or is that general attorney?). There is no escaping the shock of Birferstan so don’t expect the witch to be buried under the house.. OK all you Birfers click your heels together and wish Obama to lose.     Um, actually I took a 10 day vacation from Fogbow. I haven’t had a break in more than three years. I’m studying for my Windows7 certification test on Mar. 6, gonna be a Microsoft Certified Technical Specialist, woo hoo. That’s how I turned up on Doc’s doorstep in swaddling clothes a few days ago. Just keeping my hand in, without the hassle of being admin. Here I can play “just plain Obot”. 😀

    But I do have my contacts, so I knew these new briefs were on the way to Fogbow. If I go over there, I’ll get sucked right back into the vortex. I was just giving y’all a heads up ‘cuz I don’t want poor Doc to have to spend another day poring over scholarly journals, poor bunny. :mrgreen:

    I feel kind of sorry for the birthers. Their mommies and daddies will be tucking them in the night of Feb 29th, telling them that, if they’ve been good little birthers, Sheriff Joe will bring them everything they asked for. Then, on the 1st, they’ll rush downstairs in their pajamas, eyes full of hope and wonder, only to see that Sheriff Joe ate the cookies, drank the milk, and took a huge steaming dump under the Birther tree.

    I recommend that you also see what you can do to get a hold of some beta Windows 8 stuf…that is supposed to be one of the biggest OS changes for Windows (to take the destop/laptop OS and merge it into something that is also “Tablet friendly”) and is the big anticipated release for this fall…

    Thanks, Foggy. However, looking at the motions filed by Lavelle, I don’t see that there will much of interest happening. It looks like a trivial dismissal of the case on lack of standing.

    But Lavelle is asking for costs.

    More important, Mario will probably be there in court. It would be sweet for the judge to tell him to go away, his application for admission pro hac vice is denied solely because his legal arguments are frivolous. And that IS the only ground Lavelle listed for denying it.

    I should mention that Mario filed a 199-page brief 😯 today. That will lend credence to the “Don’t let him play because he files frivolous crap” thingy. If you want a judge to read your brief, keep it under 5 pages, they’re busy people. Mario apparently never learned that.

    He managed to skate away from the Third Circuit on sanctions. This would burn his butt, even if he doesn’t have to pay a nickel to the court. If the judge simply turns down his application for admission pro hac vice, I’ll be a happy Obot yes indeedy.

    As I’ve mentioned, I found it quite entertaining to see all these challenges start appearing in PA. Everything I’ve read on their ballot rules makes this a very difficult state to contest any of the Birther types of arguments at all.

    One wonders whether he’s managed to get a copy of the BC from Hawaii. Politically, I would think he would want to either throw the birthers a small chicken bone, or at least let them down gently. If he’s asked for and gotten a copy of a valid BC, it’s going to be difficult for him to do the former.

    If he goes too far birther, that could hurt him. If he totally dashes birther hopes to the ground, that could hurt him as well.

    Joe might even call for a congressional investigation, because there are so many questions.
    He tried to get to the bottom of it all, but, well, there are just too many questions.

    It will be a big load of nuthin’. But the birthers will call it a victory because he called for a further investigation. And the nonsense will continue.

    Definitely John! Arpaio has been trapped by this from the first. Politicians have to chose their appearances and associations wisely. Arpaio walked right into the trap laid by Corsi, and allowed himself to be reeled in by trying to avoid confrontation.

    Or at least that’s the impression I got from the coverage of the infamous Tea Party meeting at which Corsi passed a petition, and the initial reporting of its presentation to Arpaio the next day (Corsi and his band of RWNJs cornered him in his office and sweated him for an hour). WND’s initial reported Arpaio response is very tepid and nearly dismissive:

    Arpaio explained in a statement that he has agreed to “simply look at the evidence these people have assembled and examine whether it is within my jurisdiction to investigate the document’s authenticity.”

    “I indicated in this meeting that I will also consider whether there is a more appropriate Arizona agency to determine the document’s veracity and ultimately whether the president’s name can lawfully be entered onto the 2012 election ballot,” Arapaio* said.

    The same day, a local phoenix radio station reported:

    PHOENIX — Maricopa County Sheriff Joe Arpaio has denied that he “promised” Tea Party leaders in Arizona to investigate the validity of Barack Obama’s long-form birth certificate to determine the president’s eligibility for the 2012 election ballot.

    A month later Corsi reported the formation of a volunteer posses headed by a few lawman and staffed by Tea Party volunteers. And, oh, how the story has ballooned from there. Claims of up to 10,000 posse members, etc.

    On 2/12/12, Corsi reported on a petition of 100K signatures in support of Arpaio (hey, let’s check those signatures out!) … humorous note in the article: “The power to constitute posses is authorized to Arizona sheriffs under the state constitution.” Hmm, yes, but what in regards to the Office of he President? Vital records in Hawaii? Any Constitutional matter?

    The latest at WND is that live coverage of the Arpaio show will be available and that you can sign up to receive a free copy of the report the second it’s made available to the press. Note that if you do so, you agree that: “I understand I will be signed up for FREE WND alerts. I can unsubscribe at any time.” LOL! So, whether or not any report is released, whether or not its contents if any are worth a flip, you will be sucked into a universe of frightwing spam! What a deal!

    Note that all along through the reporting, coverage of Arpaio’s troubles with the DoJ are interwoven with the posse action. As though they are somehow equivalent!

    I expect Arpaio to continue to weasel. Anything released will be a Taitzian pile of random hearsay and gossamer. As always, quantity indicates quality in birferstan!

    If I am correct, then assuming Sheriff Joe goes public on Thursday with the results of his investigation, there is a good bet his Cold Case Posse will report that Obama is NOT a Natural Born Citizen. Their analysis into the question will be similar to what Mario has produced. Doc says the brief sounds something more for the Public rather than for the court. This could in fact be true if the Cold Posse analysis is similar to what Mario has produced. The public can then read for themselves that Obama is NOT a natural born citizen. Such a public analysis could definitely be used as a basis for numerous other state ballot challenges both in the Primary and possibly the General Election. Such an analysis can then be touted as from an official and legal authority that has taken up and researched the issue in full leaving no stone unturned. Such an analysis will also serve to conflict with Jack Maskell’s CRS report should obots argue that the issue as already been examined by a legal authority.

    I think it very unlikely that Arpaio’s investigation would be a legal opinion on constitutional language. That’s a matter for the courts, not law enforcement.

    From the scientific perspective one can never go wrong saying there are still more questions and more important research to be done (and more grant funding needed).

    Foggy: I loved ASK’s “steaming dump under the birther tree” so much, I posted it on Birther Report

    The comments at that site offer a telling look at the birther base. Sometimes, though, I have no idea what those folks are saying, e.g. just after your post someone left this chestnut:

    “We’re going to have a curse period in our country. But it hasn’t happened yet. BO just shows us kind of what the curse period will be like when it happens. Notice how everything that he does turns out to be no good for him and us.

    “Well, just a few decent years left. That is no joke. Then we get to experience a curse period that really hasn’t started as of yet, but we’re getting a true taste of it with BO.”

    Curse period? Is that hipster slang for menstruation?

    Certainly not in Hawaii. Law enforcement isn’t mentioned in 338-18. I think that might be covered under court orders, as law enforcement would go to a judge and get an order.

    In California, anyone can get an informational copy of a birth certificate. However, law enforcement specifically can get a full “authorized copy” and isn’t required to have a notarized application if done by mail.

    That’s the news from Lake Obegone, where all the women are dentists, the men are looking under the beds, and the children are quietly filing emancipation petitions.

    Dr. Conspiracy: I think it very unlikely that Arpaio’s investigation would be a legal opinion on constitutional language. That’s a matter for the courts, not law enforcement.

    Let’s not forget…..the posse has no – zip, zero, nada – legal authority, no police powers and no prosecutor is going to take up their work as the basis for any action.

    Arpaio will weasel. The only question is how.

    The posse isn’t “law enforcement”. They are non-sworn (no police powers) volunteers.

    Speaking of law enforcement’s powers I noticed on N.C.I.S. last night that Gibbs asked about a warrent coming through before he attached a GPS tracker to a car, per the SCOTUS ruling.

    Gary Miller: My Sheriff Joe prediction: He’ll say there are so many questions, so many unanswered questions. We’ll probably get the old standby “For an administration that promised transparency, there shouldn’t be so many questions. Why are there so many questions?”
    Joe might even call for a congressional investigation, because there are so many questions.
    He tried to get to the bottom of it all, but, well, there are just too many questions.

    Pretty much matches my predictions from more than 2 months ago.

    Then again, after hearing (on birfer sites) Joe will only announce a “preliminary report”, it’s probably going to contain even less tangible information and more ominous allusions along the lines of “we found many suspicious things, but we cannot comment on any of them for strategic purposes, and we’ll have to dig deeper for another 3-5 months, please send money and I’ll stack up the posse by another 3 douche… uh… expert investigators.”.

    WND is reporting that AP, Reuters, Univision, the Washington Times and NBC, CBS and ABC affiliates, as well statewide radio networks, among many others are planning to attend the press conference tomorrow.

    Might be a lie, but that would be a particularly stupid lie even for WND.

    I going 180 from most other predictors.

    The “posse” is composed of real lawyers and former investigators who work under the color of law.

    The information on the birth certificates has been confirmed by multiple Hawai’ian officials and must be accepted at face value.

    Orly and the flying monkeys will be run over by the bus when the investigators note that relevant prosecutors were advised that there is evidence that they are colluding to violate laws restricting dissemination and access to personal data on government web sites.

    SSN fraudgate is completely unsupported due to the unreliability of the data.

    The President was forced to get a new SS# due to Orly and her flying monkeys.

    As official investigators, their decisions must be based on the current interpretation of law therefore natural born citizenship must be considered as based on U.S. vs. Wong and the actions of Obama’s parents (Soebarko, Soetero) cannot change his citizenship status so those accusations were not considered other than to state that none of the information provided to the Posse constituted evidence of adoption, fraud on the part of The President, or fraud by anyone against any institution within the United States.

    Birthers decry that Sheriff Joe was replaced by a doppelganger.

    Remember, birthers are experts of playing up expectations right up until their failure.
