Kerchner challenge dismissed

Without reaching the merits of Mario Apuzzo’s 199-page brief on the philosophy of natural-bornness, a Pennsylvania judge has dismissed the ballot challenge lodged by Charles Kerchner and fellow Pennsylvanian Dale A. Laudenslager.

Judge Keith B. Quigley agreed with Obama’s attorney John Lavelle that the court did not have jurisdiction to hear the claim. A fatal flaw in the plaintiff’s case became apparent when it was revealed that President Obama’s nomination petition did not contain (nor was supposed to contain) any statement that Barack Obama is eligible to be President, hence nothing to challenge.

Based on this outcome, one would expect the dismissal of the other complaints in Pennsylvania by Phil Berg and Jim Schneller. One may also expect and motion to reconsider and/or an appeal by the challengers.

    Schneller’s case was also on the docket for hearing at 10am today. Same time as Kerchner/Laudenslager.

    I am assuming that it was also summarily dismissed for the same reasons. In reading that initial paragraph of the report, I get the sense that the plural use of claims and voters includes the Schneller case as well as the Kercner/Laudenslager one.

    Had they not ALL been dismissed this morning, I would have expected some note of that in the report. As I’ll explain in a moment, the same failure of standing issue applied to all those heard this morning. Therefore I suspect they were heard at the same time in order to lump them together and dismiss all of them for mostly the same reason.

    The difference between these cases and Berg’s (beyond the obvious “born in Kenya / Indonesia” old-school Birther angle) is that Berg is a registered Democrat and the other plaintiffs were not.

    Therefore, the issue of Standing is different for Berg’s case than the others. (The PA rules for these ballot challenges required someone being of the same party for Standing. So Kerchener, Laudenslager & Schneller as registered GOP all failed at that threshold alone).

    That is why I suspect Berg’s was the only one scheduled for a later hearing time (03/19/12). There is mention of a separate Schneller case on that docket list, which has not yet been scheduled.

    ROTFL… Arpaio submitted nothing new, looked at known copies and concluded that they could not determine anything about the originals.

    In the mean time the Department of Health of Hawaii has more than once verified President Obama’s birth on US soil.

    Bummer really, but the state election challenges are failing on a variety of reasons, including the fact that President Obama is clearly natural born.

    As I’ve mentioned, other than the initial surprise that someone who should be more politically savvy would “double down” on such nonsense, there really wasn’t much more to it that was shocking at all. Just retreads of long debunked WND claims dealing with PDFs and such, In other words, much ado about nothing.

    For such a big press conference from such a well-known media figure, it sure has generated very little national coverage…and most of that is quite mocking and unfavorable – both in the story and in the comments.

    So yeah, WND’s “Trial Balloon” to try to ressurect Birther hype seems to be turning out to be a resounding DUD.

    By the reactions so far, expect the story to maintain very little traction and just become another in a long line of EPIC FAIL attempts by the WND BIrther propaganda machine.

    The Dunham high school signatures age 17 or 18 shouldn’t change at age 18 on the Obama White House birth certificate. Sorry.

    Since you can’t find any legal documents that support The Obama Story parentage, you can find the Dunham high school signatures at the following link to knock down all of the bogus documents legal and otherwise.

    A legal document has to have a valid signature or it is invalid.

    Bone up on the circa 1961 Royal standard manual typewriter font. The No. 1 key was absent so the small L key had to be used. On an Obama documentmade by that typewriter all one letters and small L letters are the same. They are a host of them.

    By the way, Dunham was born November 29, 1942. Her birthstate Kansas has a school attendance cut off date of August 31th. Thus she was high school Class of 1961. The conception time of the alleged Obama birthdate August 4, 1961 was November 1960 when Dunham was in a Washington state high school.
