    I just wanted to note that Helen is back, and has yet to answer any of my questions, despite the fact that she continues to ask her questions.

    Helen, since you’ve established that you are old enough to remember President Roosevelt, let’s see some comment from you criticizing the expense of taking care of Fala.

    Don’t like Pres. Obama’s vacation? Think he should stay in Washington 24/7? Perhaps you can re-print for us your criticism of Pres. Bush for spending more than a year at taxpayer expense in Crawford. He was there ignoring 9/11 warnings. He was on vacation ignoring Katrina warnings.

    Think Lakin is a hero? But for his medical expertise (and I question his judgment) I would have given him life at Leavenworth. He can treat prisoners. I’m one of those people who needed medical treatment in the field. Lakin but real soldiers at real risk.

    But why can’t you answer questions?

    Where was Pres. Obama born?

    On what evidence did you rely in voting for Sen. McCain and Gov. Palin that they were natural born citizens? Or was it that they are white so you don’t need evidence.

    You guys are the nicest people on the ‘net. I can’t believe your patience with the nutters.

    We are coming up on 10 years since Pres. Obama spoke at the national convention. My son and I watched it on tv, as I wanted to inspire him to dream big, despite living on a small island in the middle of the Pacific with a foreign dad and experience living outside the US.

    I hope that world awareness becomes commonplace in the US.

    CNN’s Athena Jones investigates if Sen. Ted Cruz is eligible to run for president. CNN says the “natural-born citizen” question is dogging Cruz. For the record, CNN said every constitutional law expert they interviewed said Cruz is a natural-born citizen and eligible to be president.

    ATHENA JONES, CNN CORRESPONDENT: Hi, Wolf. The big question here is whether Ted Cruz is a natural-born citizen.

    I spoke with several constitutional law experts about this today. And all of them believe that Cruz is. But it’s important to know the Constitution doesn’t define who is a natural-born citizen.     Let me share a personal story.

    I don’t drink alcohol. The reason that I don’t is because of some disgusting behavior I witnessed as a young teenager from a friend of mine who got intoxicated. I made a conscious decision never to be like that.

    In the same vain, looking at the birthers, I never want to be like that.

    OH i concur which is why i posted the laurie article from “cain tv” whatever that is – i have questioned mitt & george romney, cruz, rubio, etc only for consistency and not because i believe they are ineligible – i have also questioned the vattelists due to the english translation of the french “les parents” and was told by apuzzo to “ask a french waiter” what it meant – and then the “kenyan muslim marxist socialist clown” was reduced to the forgery of a document wherein the (supposed) forger copied the same data from the original document to produce another document which thereby makes obama ineligible?

    and then big-mouth, crucifix-wearing, hatred-spewing ATTORNEY coulter says we have to speak with law professors about cruz? haven’t we done that?

    and now, when obots never believed obama ineligible and some, like new hair for men, trump, etc again raise the question of eligibility (for publicity), we, obots, are referred to as “loony PROGRESSIVE subsets”, “LEFTIST GOONS” and aligned with “’The Donald’s” one-man circus”? it’s incredible –

    Ok, I don’t know whether Ted Cruz is a natural born citizen, as I do not know the poliical status of his father while in Canada. And I do not know if he has received a certificate of ciizenship from the American Consul in Canada.

    If you are born out of the country to one american citizen parent as that country may consider the child as a citizen of their country. or following the citizenship of the father, not the mother.

    Now , if he comes in as a citizen by birth,father not a ciizen, he would have to be citizen by law, and not a native born or natural born citizen.

    (2) A child born out of wedlock in a foreign country to an American citizen mother and an alien father or U.S. Citizen father gains U.S. citizenship at birth if the mother had been physically present in the United States for a continous period of 1 year prior to the child’s birth. (See 8 U.S.C. 1409(c).) The child will gain the citizenship of the father only if the laws of the nation of which the father is a citizen so provide.

    So, who know what will happen as the Democrats play birther to keep him off the ballot.

    The Naturalization Act of 1790 declared people born outside the country to two citizen parents NBC. Why did the Founders do that if they “knew” that “natural born” does not derive from man-made laws as you allege?
    (Yes, I know, birthers love to pound on how the act was changed by its 1795 version, but it doesn’t change that fact that the Founders enacted a *law* referring to NBC. This would’ve been impossible if you were right.)

    That’s just another birther invention. Just like the Democrats didn’t go birther on McCain, they won’t do it on Cruz (if he ever runs, that is). Obama birthers however would.

    The “now Democrats are going birther on Cruz” is a birther invention devoid of any reality. It’s as cynical as setting fire to your neighbour’s house and claiming he did it.

    Some guy on Twitter was saying something like this. I don’t know where folks get these ideas. Maybe they are projecting their own attitudes on other people. Folks on the right are the ones who are fanning out across the Internet trying to drum up an anti-Cruz birther movement. Folks on the left know he’s eligible and I think he would make a great losing Republican candidate. Just last night I told a friend that I was considering putting a Cruz sticker on my car.

    There is no reason to keep him off the ballot. As Dr. C has said before, the fundamental mechanism used to determine whether Cruz, or anyone else, should go into the White House, is called an “election.”

    I am not worried that Cruz will sell us out to his wily Canuck fellow travelers, just as I am not worried that Rubio is a Batista mole, or that Bobby Jindal owes any kind of fealty to India.

    No, they all bother me for completely different reasons, but I’m not the slightest bit interested in making crap up to deny them their chance to crash and burn on the national stage.

    I’ll be the first Obot to question if Cruz is a natural born citizen, just as I also questioned McCain…in part because I haven’t researched the issue completely (so if there is an amibitious lawyer out there who has or knows of a journal article..please share). NBC is an undefined term used in the Constitution. We look to the common law to determine the meaning of undefined terms used in the Constitution. WKA, following the common law, defined NBC as born within the territory and subject to the jursidiction. Now NBC only matters, to define who can be President and Vice President. Otherwise, it carries no additional benefits as compared to a naturalized citizen. Now the issues I question is, can Congress redefine a term used in the Constitution in such a way that it is a de facto amendment? So if they can re-define NBC to include those board abroad, what is stopping them from further redefining it to include an even larger group (i.e. any minor child who accepts citizenship by virtue of their parents naturalization). Couldn’t they just keep going and rendering the clause meaningless? All without going through the actual steps required for an actual amendment. And why couldn’t they do the same for other terms in the Constitution? Seems to me that if the legislation is causing a real change in the meaning of the Constitution, it should have to go the route of an amendment.

    Second issue. The Constitution grants Congress the power to pass laws regarding naturalization. So by extention, shouldn’t anyone who can only point to a statute for the basis of their citizenship be considered “naturalized”?

    OK..so those are my academic questions on the issue. But while I have an academic curiosity on the subject, should Ted Cruz run for President, be nominiated, and God forbid, be elected….I will not be filing complaints with the courts, FOIA requests, or calling him an ursurper. I may try to write a journal article on the subject…but I highly doubt that. I keep saying I’ll write an article on junk law and the birthers, and still haven’t done that after how many years now.

    And if there is someone who has researched this, or knows of a good quality journal article on the subject…feel free to correct the error of my ways.

    Well, we know that if a child born abroad to two American Citizens the child is an American Citizen, but we don’t know if the child is a native-born, or natural born citizen.

    But a child born abroad to an American Citizen who is unmarried is not a citizen at birth
    And a child born aboard to an American Citizen who is married to an alien citizen is not.

    Native born, is a NBC,if born on two American Parents, but a child born abroad is not a native-born citizen.

    Now it is common usage to say a native born citizen is a natural born citizen.

    but is it that a natural born citizen may be born abroad.?

    If so , then does “natural born” and “native born” mean the same thing.

    Obviously not!

    And then, it become obvious that “native born” is a legal determination and does not automatical ensure “natural born” status.

    As you can be “native born” and not be a US Citizen at all!

    So, it eventually works out that the only ‘natural born’ citizens are those born of two American Citizen and being born in the United States of America.

    Contrary to what virtually all of us learned growing up. My very conservative ex-marine civic’s teacher drilled it into us all

    “anyone born in the United States could aspire to grow up and be elected President of the United States”-

    because unlike Europe of old, here in the U.S., a parents status didn’t mean squat when it came to being elected president

    Former Supreme Court justice Sandra Day O’Connor: “All of our Presidents have, to date, been born in the 50 states. Notably, President Obama was born in the state of Hawaii, and so is clearly a natural born citizen.”

    But. I have good news Helen. Your unamerican ideals still have value, for you that value was one vote. The bad news is, you lost. But, keep up your unpatriotic stance, 2016 is coming and you can vote for your pub candidate like Cruz…wait, to you he’d be ineligible. Ok, then Rubio! Oops, you’d make him ineligible too.     I’ve listened to a couple of birther blogtalk shows recently and seen the videos of birthers embarrassing themselves and their members of Congress. These birfoons really seem to believe that Reps. Stockman, Yoho, and Barletta have agreed to push for an investigation in Congress. When nothing comes of this, I think we will be looking at an epic birfer temper tantrum. Perhaps we will see something along the magnitude of the birfer tears we saw when they realized that Darrel Issa wasn’t going to hold birfer hearings after the GOP took over the House in 2011. Or when Ben Shapiro of Breitbart Media told Joey Farah and WND to STFU about the birfer conspiracy theories related to Andrew Breitbart’s death. Fun times ahead!

    Who can blame them? They haven’t had an OMG moment in months, ever since the CCP stopped releasing new stuff and Orly’s cases/hearings faded into oblivion.

    They’re on cold turkey which actually causes some of them to sober up about their wild fantasies – e.g. the number of birthers placing their hopes on Orly’s “whistleblower” is small, even on Orly’s site (which hardly gets 5 comments per article as opposed to the dozens in the past).

    On Twitter, you get the occasional reference to the Alabama SC case, but most of them probably understand by now that if Roy Moore wanted to go real birther (i.e. actually buy into it and not just pay lip service to the wingnuts), he’d have made a ruling by now “because national importance”.

    After all the alleged time you spent pondering the legal status of different types of citizen, you still missed the actual difference between native-born and native-and-natural-born:
    Those native-born who aren’t natural-born are children of foreign diplomats and invading armies (and, back in the Founders’ days, Indians not taxed). *That* is your difference set, not your invented “those who don’t have two citizen parents”.

    Please identify a single history text, civics text, or Constitutional law text which states that a natural born citizen must have two citizen parents.

    Get on this assignment right away, because it’s going to take you a while.

    congress’ gold standard is the CRS which found there is no requirement of two “citizen-parents,”

    CRS says: “The weight of legal and historical authority indicates that the term ‘natural born’ citizen would mean a person who is entitled to U.S. citizenship ‘by birth’ or ‘at birth,’ either by being born ‘in’ the United States and under its jurisdiction, even those born to alien parents; by being born abroad to U.S. citizen-parents; or by being born in other situations meeting legal requirements for U.S. citizenship ‘at birth.'”

    Cruz, by being entitled to citizenship at birth because his mother was a U.S. citizen and by being in the U.S. for more than 14 years, would seem to qualify as a “natural born citizen” under the definition in the report.

    At ORYR, you can hear Carl Gallups and “Lieutenant” Mike Zullo bellyaching about Florida Congressman Jeff Miller reneging on their amazing meeting. Birther tears– oh, so bitter, so bitter and so sweet.

    Gallups claims that they’ve always said that if they turned their “evidence” over to someone like Miller, and he could show them that “it’s all a crock,” then they would “walk away from it.” Apparently, Carl and Mike don’t understand that by refusing to meet with them, Miller is, indeed, trying to show them that their evidence is nothing but a crock.

    I am an ardent Obama supporter. Cruz is eligible to run. He has citizenship by birth, not by naturalization. Rubio was born in Florida, to Cuban citizens. He too has citizenship by birth.

    Ok, I don’t know whether Ted Cruz is a natural born citizen, as I do not know the poliical status of his father while in Canada.And I do not know if he has received a certificate of ciizenship from the American Consul in Canada.

    If you are born out of the country to one american citizen parent as that country may consider the child as a citizen of their country. or following the citizenship of the father, not the mother.

    Now , if he comes in as a citizen by birth,father not a ciizen, he would have to be citizen by law, and not a native born or natural born citizen.

    (2) A child born out of wedlock in a foreign country to an American citizen mother and an alien father or U.S. Citizen father gains U.S. citizenship at birth if the mother had been physically present in the United States for a continous period of 1 year prior to the child’s birth. (See 8 U.S.C. 1409(c).) The child will gain the citizenship of the father only if the laws of the nation of which the father is a citizen so provide.

    So, who know what will happen as the Democrats play birther to keep him off the ballot.

    Now it is common usage to say a native born citizenis a natural born citizen.

    There remains a healthy variety of political thought in the US. Due to the noise and groupthink of the crazy rightwing, it only appears to be polarized, the nutballs on one side and everyone opposing them on the other.

    It’s more like an unbalanced washing machine. A big lump of dead weight on one side that needs breaking up and redistributing.

    I agree that that should be done, but there is an inherent problem with doing it. Since we don’t have an original of Obama’s birth certificate to test with and we cannot determine precisely the color and contrast of the original, there’s a good chance the halos will be a touch different–bigger or smaller maybe. Birthers will grasp at any straw including any minute difference in the halos. Of course, they could be dead on too.

    <tongue_in_cheek>The Cold Case Posse spent hundreds of hours and massive amounts of money creating a nearly-perfect test version of the Obama birth certificate. It’s a shame that they chose not to share that document with the public.</tongue_in_cheek>

    Well duh … but the only something is a bunch of whiners spreading brain disease, that are in need of a good disinfecting. I take it that asking whether he is aware he’s indulging in a juvenile fallacy is moot.

    Dr. Conspiracy: I agree that that should be done, but there is an inherent problem with doing it.

    Of course, of course. We neither have the original, nor do we know the exact model WorkCentre, it’s working condition, etc, etc. But we do know it was a WorkCentre, scanned as a text/line art document, and that there was a hard copy. Testing a mockup is showing off, rubbing it in, the icing. Not done for the birfer’s benefit (since they refuse to benefit, what can be done for their benefit?), but as a capstone, a cherry on the sundae.

    Of course, it would be more of a test of how good the mockup is, rather than how right the identification of the method. The latter is nailed already.

    Speaking of rubbing it in, I recently adopted 2 chihuahuas. They’re adjusting to a new environment, new schedule. There have been a few accidents. The way they studiously refuse to acknowledge those accidents reminds me of birfers dancing around the undoing of PDF Madness. If a scan of a mockup is posted, you can be sure “Medici” will pop up, halometer in hand. Watching such desperate gymnastics are approximately 50.1% of the fun, Doc!

    Well, it is an examiner article. A big chunk of it involves someone who wants Senator Cruz to be the nominee arguing that Rand Paul is playing a dirty smear. The article does quote someone who is a Rand Paul supporter, but it is pretty tepid. Shipley (the Rand Paul supporter) says that Senator Cruz needs to address this, but the article goes on to say that Shipley feels that it wouldn’t be hard to do so.

    Pretty weak tea.

    A member of a Minutemen militia was arrested Saturday night for allegedly pointing his AR-15 semi-automatic rifle at a Maricopa County sheriff’s deputy.

    Richard Malley, 49, and two other group members were patrolling the area along Interstate 8 in search of illegal activity when two deputies approached, according to court documents. The Minutemen watch for unauthorized immigrants and drug smugglers crossing to Arizona from Mexico.

    Malley pointed his rifle and flashlight at one of the deputies. He was also armed with a .45 caliber pistol and a fixed-blade knife.     Rickey: The interesting thing about the comments is that I don’t know a single Obot who has argued that Ted Cruz isn’t eligible. His potential candidacy does put birthers in a bind, though. If Cruz is eligible, then Obama is eligible regardless of where he was born.

    In Italy, it happens quite often that tourists are stopped by robbers dressed as cops on lonely roads. There are even recommendations to *not* stop but drive to the next police station in such a situation. Just imagine this happened in the US, I suppose the driver would be shot before he reached the next town.

    The biggest potential threat to Mike Zullo is Sheriff Arpaio. That KPHO interview where Arpaio threw Zullo under the bus must have been uncomfortable. Arpaio just might ask some uncomfortable questions. My IRS referral dealt only disclosure, but others that have been filed actually allege misuse of funds with specifics and demand excise taxed be levied against the posse. That’s what Zullo should focus on.

    I am certainly not concerned about a play policeman from Arizona focusing on me. Indeed “focusing” sounds like just more of his pseudo-law-enforcement jargon. I am a profoundly uninteresting character. But perhaps Zullo would do better to focus on other Obots who are actually digging into Zullo’s personal finances and background, material that you will not see published here unless Zullo is charged with a crime in relation to it.

    You are absolutely right. The other player in this area is the county itself which carries the liability for actions taken in its name. It has already paid out millions of dollars for myriad wrongdoings by the sheriff and his minions over the years.

    If I were the county’s insurance carrier I would want to know more about these organizations that have Maricopa County in their name, wear badges and uniforms with the name on them and act on behalf of the county……but, according to the sheriff, aren’t part of his office or the county.

    Under scrutiny it won’t fly.

    ok, bit of assistance needed here guys.

    been looking at ann dunham’s passport applications on scribd, and in none of them does it mention the president in any of the boxes for children.

    so how did he leave hawaii for indonesia, and then return later without a passport?

    i’ve been using search here, but not getting any results

    it suddenly dawned on me with embarrasment that after all this time i had a hole in what i know, and to be honest had never considered it.

    Doc could certainly answer better than about anyone else but I seem to recall the answer is that young Barack probably had his own passport by the time he returned. I believe Doc made that inference from what was supplied in his FOIA request to the State Department.

    He went to Indonesia on his mother’s US passport. She took him off that passport IIRC in 1967 and probably got him his own US passport. Maybe they knew he would be traveling back to Hawaii by himself.

    Why is he “least likely”? He’s been blathering recently about impeachment, and according to the Miki tape, he actually did have his aides give The Zullinator a call — twice!

    (I was amused that Miki already knew about these calls — from the CCP side. And if I was hearing this correctly, Commander Pornstache was very, very disappointed that Coburn himself wouldn’t get on the phone personally with Shurf Joe. I think Miki got some demerits from the Z-Man for failing in this part of her mission. Coffee is for closers, Miki.)

    Coburn is one of (*sigh*) ‘my’ senators, one of Okieland’s best and brightest. I said he’s least likely to birf, not least likely to be a rightwing extremist! He’s at home in August, doing the town hall circuit (just like ol’ Markwayne was …), pushing all the buttons of The Faithful, and stroking their crazy. It is despicable, and yes, his melodrama regarding what he sees as the administration’s lawlessness has been a local story:

    And it is easy for a sane person to see that when a public figure encounters an approaching Birther or realizes one has pulled inside of Birther-exploding range, that public figure goes into assassin-survival mode, giving vague, disengaging responses, which the Birther then narrowly parses and widely publishes as commitments made to the Birther by the “interested” public figure!

    And Coburn’s “promise” to call Sheriff Joe for a CCP update, as a substitute for starting a Congressional investigation to march Obama out of the White House!
