“It’s an insult to his mother”

The utter lack of disrespect that some birthers show towards the president’s deceased mother appalls me, particularly the frequent claims that she is a “liar”. I was raised not to disrespect anyone’s mother, and particularly not a departed one, and I was taught not to call anyone a liar unless I was pretty damned sure it was true. What compounds the insult is that there is no evidence whatever to support the nasty speculation.

The New York Times article earlier this month, carried comments from Congressman Neil Abercrombie.

… Mr. Abercrombie, who has represented Hawaii for nearly two decades in Congress, was a close friend of Mr. Obama’s parents, who were students at the University of Hawaii in 1961. The president’s father, Barack H. Obama Sr., was from Kenya, but Mr. Abercrombie said the suggestion that the Obama baby was born in Africa is an absurd impossibility.

“He was born in Kapiolani Hospital, right down the street from where I lived,” Mr. Abercrombie said. “They had no money. I can’t imagine how they would get to Kenya. It makes no sense at all. It’s an insult to his mother.”

I agree.

Yet another Kenyan birth certificate

This one is on YouTube. I think the videographer intends the viewer to interpret this sideways video as having been shot in Africa (hence the black extras), and one gets the impression that the speaker has obtained a birth certificate locally.

The video is too shaky and the resolution too poor to do much “analysis” of the document on the screen. Some might be able to freeze frame the image and record some details to see if it is consistent with a real document. The main point to keep in mind is that without any supporting evidence, a video on the Internet is nothing but a video on the Internet. However, it is entertaining, and I thought well done (for a fake).

When will the Birthers be happy?

Once again, we read a long discussion, with a rational-sounding style, laying out the facts, so it appears, about citizenship in the United States. Is it reasonable and is it true?

RESPONSE: Interesting to note that, before the issue seemed such a potential publicity boon, WND reported that its own experts determined the COLB to be authentic:

“OBAMA’S CERTIFICATION OF LIVE BIRTH UTILIZING FORGERY EXPERTS ALSO FOUND THE DOCUMENT TO BE AUTHENTIC. The investigation also revealed methods used by some of the bloggers to determine the document was fake involved forgeries, in that a few bloggers added text and images to the certificate scan that weren’t originally there.”

WND also reported that the claims that Obama lost any hypothetical American citizenship he had as a child is not supported by US citizenship law:

“In short, the suit claims Obama was not born an American citizen; lost any hypothetical American citizenship he had as a child [ITALICS IN ORIGINAL(Editor's note: This point is not supported by U.S. citizenship law)END ITALICS]; may not now be an American citizen and even if he is, may hold dual citizenships with other countries. ….

Obama birth poll shows striking regional divide

“Do you believe that Barack Obama was born in the United States of America
or not?”

A poll conducted for the Daily KOS (and this is a real poll,  not one of those unscientific citizen grand jury polls) asked the simple question: “Do you believe that Barack Obama was born in the United States of America or not?” The results were incredible:

Response to Eligibility Primer (Part 2)

This is a continuation of the discussion of the June 5, 2009, article titled Obama Presidential Eligibility – An Introductory Primer by Stephen Tonchen. We resume at the end of his section 4:

In 1898, in the Wong Kim Ark case, the Supreme Court reexamined the “citizenship-by-birthplace-alone” theory, but did not decide whether it applied to natural born citizenship. The Court ruled that Mr. Ark was a citizen, but did not rule that he was a natural born citizen (SCOTUS in ‘Wong Kim Ark’).

This is a major gloss over one of the most sweeping surveys of citizenship ever appearing in US jurisprudence. The question before the court was whether Wong Kim Ark, born in California of Chinese subjects at a time when racist legislation (the Chinese Exclusion Act) prohibited the Chinese from becoming naturalized citizens, was a citizen. The Court said that he was. But in the majority opinion, the Court said a great many things of importance, specifically:

  1. Citing Smith v. Alabama, the court said that the Constitution is framed in the language of English Common Law
  2. The Court cited English Common law, saying that those born in England are natural born subjects of England, without regard for the citizenship of their parents
  3. The Court asserted the equivalence of “citizen” and “subject”.

While US v. Wong did not decide the natural born citizen question, the majority opinion leads inevitably to the conclusion that those born within the United States (except the children of ambassadors) are our natural born citizens, without regard to the citizenship of their parents. (more…)

Is President Obama a British Citizen? (Update 3)

obamaflagAccording to a new article at nObama attorney Mario Apuzzo’s blog, he is. The article, Obama, the President of the U. S., Is Also Currently a British citizen advances the legal theory, cobbled together from bits and pieces of British and Kenyan law, that President Obama, who is acknowledged to have had a claim to British citizenship at birth, still retains that citizenship.

Let’s start this discussion at President Obama’s own campaign website, FightThe Smears.com, citing FactCheck.org:

When people decide what to believe in, sometimes they hang their faith on small things, things that are intuitive and meaningful especially to them.

Those who believe that Barack Obama was born in Africa have precious little to hang their beliefs on. Some hang their belief on the edited version of an audio recording that seems to show Obama’s grandmother saying that he was born in Kenya (not so in the unedited version). Some believe that a name on an Indonesian school record trumps everything. Some believe that Obama’s birth certificate is a forgery because it contains the word “African”.

Here is a statement of the African objection:

In 1961 when Barack Obama was born, no one in the US used the term “African” as a race. A birth certificate wouldn’t have been filled out that way by a hospital. An authentic birth record would say Obama Sr. was a “negro”. Only a young, modern, perhaps African American and politically correct forger would have made such a mistake.
