Berg v. Obama – Unsealed – Dismissed

I wrote last November about the sealed lawsuit brought against Barack Obama by Pennsylvania lawyer, Philip J. Berg. Phil Berg notified Obama Conspiracy Theories this afternoon that, the case has been unsealed and dismissed with prejudice. Berg wrote:

Since the case was ‘Dismissed with Prejudice’ it is now ‘Unsealed’ and the record is open for review. The case, Berg vs. Obama, U.S. District Court for the District of Columbia, No. 08-cv-1933 and is available on Pacer or our website, I, Phil Berg, will be Appealing this case !

I’ve had a copy of the complaint since it was misfiled the first time last year, but did not publish it out of respect for the court which eventually sealed it. The case is frivolously novel in it’s approach (claiming Obama collected his Senate salary while being ineligible to be a U. S. Senator), but the content of it is just the same old, same old case Berg filed and lost before (although this one is trimmed down considerably).

It is ironic that Berg brought the case under the False Claims Act while Berg’s claims in the complaint are all false! As we used to say when I was in school: “good riddance to bad rubbish!”

In a surprise move, the United States Departments of State and Homeland Security in an answer to FOIA lawsuit Strunk  v. U. S. Department of State denied essentially all of the birther allegations against President Obama’s eligibility! Here are excerpts from the  document filed in the United States District Court for the District of Columbia today:

To the extent this paragraph alleges that President Obama is not a natural-born citizen of the United States or is otherwise ineligible to serve as President of the United States, that allegation is denied.

To the extent this paragraph alleges that President Obama may be an illegal alien or that President Obama is or ever was a citizen of Indonesia, those allegations are denied.

To the extent this paragraph alleges that President Obama’s birth certificate has not been released to the public, that allegation is denied. To the extent this paragraph alleges that the birth certificate released to the public at the direction of President Obama is not a valid birth certificate or that such certificate is not sufficient proof of U.S. citizenship, those allegations are denied.

Specifically, Defendants deny that President Obama was born in Kenya or anywhere outside the state of Hawaii. Continue Reading →

Hollister v. Soetoro Dismissed

In a strongly-worded memorandum and order today, Judge James Robertson of the US District Court for the District of Columbia dismissed Philip Berg’s “interpleader” lawsuit, Hollister v. Soetoro. The court said: “I do have jurisdiction” dismissing the suit for failure to state a claim (since the interpleader claim had already been ruled “frivolous”).

Judge Robertson, who acknowledged that the issues raised by Berg were important on the bolgosphere and among conspiracy theorists went on to say:

The issue of the President’s citizenship was raised, vetted, blogged, texted, twittered, and otherwise massaged by America’s vigilant citizenry during Mr. Obama’s two-year-campaign for the presidency, but this plaintiff wants it resolved by a court.

Gregory Hollister (and lawyer Philip J. Berg) is suing President Obama and Vice-President Biden to force them to settle their dispute over which one of them is really president. The action is called an “interpleader” suit, typically used by insurance companies to force the issue of who they should pay a policy to by bringing a suit against the claimants so that the court decides the issue.
