Donofrio team pries previously known information out of Hawaii

I don’t want to make too much fun of Donofrio and his article DoH Reverses Course – Releases Index Data For President Obama, Stanley Ann and Barack, Sr; No Records For Maya Exist. While the fake dramatic aura written into his article is silly, at least it presents some facts.

It has been clear to me since last year that this, and another approach to obtaining records from Hawaii, if pressed, would result in disclosure of this  already-public information. The other approach is the Verification in Lieu of a Certificate. But the information pried out of the Department of Health, is the same information the DOH sent to the Hawaii news service and was subsequently printed in two Honolulu newspapers 47 years ago. I suppose it’s nice that Donofrio has another voice from the same source saying the same thing, but there is no surprise here. This really is “old news”.

Leo also “learned” that Obama’s sister, Maya Soetoro-Ng does not have a Hawaiian birth certificate which–while still claimed otherwise by birthers as recently as by a filing in Hollister v. Soetoro a week ago–is impossible under Hawaiian law. So TechDude (who claimed he could see that the COLB was constructed from a base copy of Maya’s birth certificate) is exposed as a fraud (wait, TechDude was already exposed as a fraud).

It remains to be seen if Leo Donofrio will be believed or demonized by the birthers. The odds are on the latter.

TerriK INVESTIGATION, Part 3: Hawaii AG Mark Bennett Approved Fukino’s Natural-Born Citizen Statement; All Records Should Be Made Public According To Law.

Usually I can follow what Leo Donofrio is arguing, but this latest foray into Hawaii has left me somewhat baffled. His mistakes are often subtle, but not so here. If I may summarize:

1) Hawaiian law requires that data supporting official statements be made public
2) Dr. Funkino made an official statement saying that she had examined Barack Obama’s vital records and that they show that he was born in Hawaii.
3) Therefore Hawaiian law requires the State of Hawaii to provide copies of Obama’s vital records to the public.

Before looking at the premises, I like to apply a rule of thumb I call the “smell test”. We know that in Hawaii vital records are private; they are protected from disclosure by law (§ 338-18 Disclosure of records HRS_0338-0018.htm). Now if state department of health director Fukino is prohibited by law from disclosing the record, how can she, by making an official statement permissible by law, (disclosure of index data) make herself suddenly not bound by the other disclosure restrictions of the  law? When one arrives at an absurd result, it’s time to inspect the validity of the argument. (more…)

Donofrio alleges Obama birth records amended!

Leo Donofrio has made a stunning claim on his blog in a new article: Pending Litigation: Hawaii Confirms That Obama’s Vital Records Have Been Amended.

One has to translate that headline from “birther speak” to normal usage. “Pending Litigation” means “we haven’t filed a lawsuit” and “Confirms” means “we say so, but we won’t tell you why or how”.

Hawaiian law requires that certificates that have been amended be distinctly marked “altered”, and Obama’s Certification of Live Birth clearly is not marked “altered”. This fact justifies a high degree of skepticism on Donofrio’s claim. Of course the word “Amended” in birther speak might mean something totally different from the normal usage.

Donofrio says:

I will issue a full statement and press release on behalf of TerriK via this blog in the days ahead.  This statement will include a complete history of correspondence between TerriK and Hawaii state officials in the Office of Information Practices (OIP) and the Department of Health (DoH). (more…)

When I read Dr. Fukino’s statement in the Hawaii Advertiser, I could almost feel how angry it would make the denialists. I also read a touch of anger in Fukino’s statement–she must  be certainly way past fed up with the whole business.

All of the speculation about foreign registrations under Hawaiian law 337-17.8 and the theories about secret meaning in Fukino’s official statements last October were trashed. The director of the State Department of Health said plainly that Obama was born in Hawaii. For those who have been struggling to gain mind share over the Internet, this must be devastating. Most people still befuddled by birther misinformation will fold up their tents and go home, leaving no one but the hard core Obama haters.

Add to that a week full of media coverage, almost universally negative, with even conservative outlets like Fox News calling the whole business crazy. Even the bastion of conservative intellectual thought, the National Review said: “… this theory is based on unreality, as two minutes’ examining the claims of its proponents reveals.”

Then there was the gratuitous end to Fukino’s statement that Obama is a “natural born citizen”. I can hear them yelling, “HOW DARE SHE! Who is SHE to say who is a natural born citizen?” (The white supremacists may have added a few other choice words in place of “she”.) But who are folks like Orly Taitz and Mario Apuzzo to say that he is not? She is only saying what judges and US attorney generals have said for years. But how arrogant that must have sounded to those whose own unbounded arrogance causes them to ignore mountains of legal opinion and claim that they alone know how to interpret the US Constitution.

No, it has not been a good week to be an Obama eligibility denialist. They must be pretty angry and I understand why.

Clearing the smoke, or blowing more smoke? (Update 2)

A new article titled: “Clearing the Smoke on Obama’s Eligibility: An Intelligence Investigator’s June 10 Report” has been posted on the Western Center for Journalism web site (while an impressive name, the site is just another front for Joseph Farah of WorldNetDaily).

…In December ‘08 a retired CIA officer commissioned an investigator to look into the Barack Obama birth certificate and eligibility issue. On July 21, 2009 westernjournalism.com obtained a copy of the investigator’s report. Here is an unedited version of the report.

What are the telltale marks of a “fake”?

Let’s cut through the BS right up front. There is no CIA officer; there is no “intelligence investigator”. That’s just set decoration to lend an air of mystery and secret knowledge. Somebody (my guess is that it’s Ron Polarik) ordered a copy of the Hawaiian laws from 1955, and reedited  them to make it appear that the writer was some sort of expert, and that the resulting “report” was serious. But how about the content, which purports to be an analysis of Hawaiian vital statistics law?

The bias of the report is immediately evident in this damning accusation:

The fact that Obama refuses to release the vault birth certificate that would instantly clear up this matter almost certainly indicates that the vault birth certificate is probably a BC2 [unattended birth] or possibly a BC3 [delayed certificate].

Here is another little trick in the report, which suggests that the Hawaiian Health Department is lying!

The document at the Department of Hawaiian Home Lands website indicates that at the time she [Health Department spokesperson Janice Okubo] made this statement it was false, and that a procedure was in place for application for “the original Certificate of Live Birth.” (more…)

“to investigate without a reason is what I call a smear campaign”

I received an email from Mr. Leahy, directing me to a post on his blog and asking for my comments. Leahy (self-described Conservative author and grassroots new media strategist)  raises a number of “questions” rhetorically posed to Hawaiian officials to dig into all the nits of what they did and said. Some of the questions are ones I might ask out of curiosity, but some presume long-discredited conspiracy theories, or would be unlawful to answer.

I replied to the email this way:

I think your “questions” can be categorized into three groups:

1. Questions which cannot by law be answered by the persons to whom they are directed.
2. Questions which have already been answered, deal with scenarios which are contrary to law or contain misstatements of law.
3. Questions which are irrelevant to the time and place of the President’s birth.

President Obama’s Certification of Live Birth says on the face of it: Location of Birth: Honolulu. What exactly don’t you understand about that?

If there were ONE TINY FACT that contradicts Hawaiian birth for President Obama, perhaps raising questions would make sense, but to investigate without a reason is what we call a smear campaign. (more…)
