Obots offer witness protection to embattled birthers

Whatcha Gonna Do When They Come for You?

First, the title is just kidding. Obots don’t have any authority to offer anything in the way of protection to birthers. I’m just a retired guy who blogs. What I wanted to mention was two recent items where birthers are being singled out by other birthers as criminals.

The first is the obvious Douglas Vogt unsealed affidavit that charges Birther Princess Miki Booth with being part of the group forging Obama’s birth certificate. Some birthers were happy to take that and run with it.

The second is the charge from Carl Gallups that Douglas Vogt said things that were untrue in his unsealed affidavit before the U. S. Supreme Court. Gallups is right, by the way.

Meanwhile one wonders how many more birthers are going to get on the “Zullo is just stringing us on” bandwagon. That sentiment certainly has Carl Gallups upset.

Birthers have never gotten along that well because the prominent birthers want to be leaders, and you can’t have everybody being a leader. Conspiracy theorists are by nature lone researchers and they do not take kindly to competing theories. The messiest example was of course the lawsuit between several birthers, including Orly Taitz, Lisa Liberi and Phil Berg. Then just yesterday we had that whiny rant from Carl Gallups declaring Mike Zullo (and Gallups as his sole spokesperson) the only one who has accomplished anything for the birther movement, calling the rest “jealous.”

Conspiracy theories tend to develop factions—just look at all the Kennedy Assassination theories, or the LIH v. MIH factions for 9/11. Birthers are no different. Their theories include:

  • Obama was born in Kenya
  • Obama was born in Hawaii fathered by Frank Marshall Davis
  • Obama was fathered by Malcolm X
  • Obama isn’t related to the Dunhams
  • Obama was born in Hawaii to Ann Dunham and Barack Obama Sr. but ineligible anyway
  • Hawaii is/is not in on it
  • Nancy Owens forged the birth certificate
  • Miki Booth and friend forged the birth certificate

Will the real Lisa Liberi please stand up?

Taitz and Berg were back in court yesterday before the Ninth U.S. Circuit Court of Appeals presenting oral arguments in the case of Liberi v. Taitz. Taitz, in an unusual display of good sense, had another lawyer to speak for her.

As of September 2012, the number of court docket entries in this long-running lawsuit had reached 982, and I am confident that it’s well over 1,000 by now. One would have thought this was a simple case: Orly Taitz said that Lisa Liberi, Phil Berg’s paralegal, was a convicted felon, and published personal information about her, including her social-security number. Liberi says that’s defamation because the Lisa Liberi felon is somebody else with the same name. But nothing is ever simple in a blood feud between conspiracy theorists.

Couldn’t we clear this up with a birth certificate, a passport, a drivers license and a social-security registration form?

Bad blood boils: Berg blasts birther

It happened to me: I mistakenly believed that Philip J. Berg’s law license had been suspended and even wrote it into an article (now corrected). Apparently I wasn’t the only one fooled.

According to Phil Berg (letter to the Court embedded at the end of this article), defense counsel Kim  Schumann and Jeffrey Cunningham in the Liberi v. Taitz lawsuit bought the story from their client Orly Taitz too, and contacted the court and had Berg removed as counsel for the plaintiffs saying he had lost his license.

Berg states in his letter to the Court that this false statement was “repeatedly posted all over the Internet  and sent through RSS feeds to millions of websites and Individuals; and repeatedly mass Emailed….” (I learned about it from a mass email directly from Orly Taitz.)

Berg demands sanctions and costs for having to respond to the false allegation.

As best I understand the facts, a recommendation was made that Berg be suspended, but no decision has actually been made to do it.

In a more bizarre part of the story, Berg alleges his computer system was attacked by Taitz, who attempted to put tracking software on it. He shows a screen shot from Norton Internet Security detecting an “intrusion attempt” while visiting her site: Norton rated the threat “high.” Google reports that the Taitz site has been clean for the past 90 days. Recall that the Taitz web site has had problems in the past with malicious software on it and the early days of her web site were accompanied by claims of being hacked, and PayPal contributions stolen, directed against Lisa Ostella, another plaintiff in the Liberi suit.

Taitz sanctioned

Orly Taitz$250 is not a lot of money, but at least it’s a step in the right direction.

Sources close to the Lisa Liberi/Orly Taitz lawsuit report that Taitz (pictured right) was sanctioned $250 yesterday by federal district judge Andrew J. Guilford for filing five motions in violation of the Court’s pre-filing order (motions must be approved before filing). The Court also sanctioned Tatz’s counsel Schumann, Rallo & Rosenberg, LLP in the same amount.

Taitz , Neil Sankey and an impressive list of co-defendants, are being sued by Lisa Liberi and Phil Berg, over the alleged defamation of Liberi by Taitz. Taitz stands by her claim that Liberi is a convicted felon, and has moved to have the case dismissed under the California AntiSLAPP law, a law that provides for dismissal of frivolous lawsuits filed to inhibit freedom of speech through the legal process.

I think that if anything, this is a cautionary tale about getting tangled up in a lawsuit. It looks like a total of six lawsuits/appeals and at least a dozen litigants including Oracle Corporation and Lexis/Nexis. There were 308 filings/orders one suit alone at the district level, and an appeal in Lisa Liberi et al v Orly Taitz et al is currently before the US 9th Circuit Court of Appeals in California.

Latest on Liberi v. Taitz

Liberi v. Taitz is an internal squabble between several Obama denialists (including Phil Berg, Orly Taitz and Ed Hale). This is not my cup of tea. However, if you want to follow it, these are the latest orders. The big “news” is that Lisa Liberi’s social security number will remain posted on Orly’s web site in the infamous Dossier #6.

In a move long anticipated, Philadelphia lawyer Phil Berg, anti-Obama activist and judicial candidate has filed suit against Orly Taitz on behalf of individuals who have come under attack recently by  California lawyer and anti-Obama conspiracy theories promoter Orly Taitz.

Orly Taitz frequently makes published assertions that two people who share the same name are the same person (like Barry Soetoro and Soetoro Moestabjab), and in this case Lisa Liberi, Phil Berg’s, associate may be the victim of just such a false association with a New Mexico felon having a similar name.

Also, former webmaster of Orly Taitz’s blog, Lisa Ostella, the recipient of all sorts of accusations related to the handling of former Orly blogs and the funneling of PayPal donations, is suing. We’ve reported here on the Ostella accusations before.
