Earlier today, crusading lawyer, Dr. Orly Taiz, DDS, ESQ, provided Obama Conspiracy Theories her latest bombshell, Dossier #6. This blog expresses its sincere condolences to the following officials who also received a copy:

The US Postal Service canceled scheduled layoffs in anticipation of the “certified mail” revenue for all of these letters and return receipts.

The opening digs out some pretty old information:

Please see in attachment affidavit of licensed private investigator Jorge Baro and forensic document examiner Sandra Ramsey Lines. Both are stating that Certification of Live Birth posted by Obama on internet cannot be viewed as genuine and original birth certificate from the vault in Hawaii needs to be produced to verify his place of birth and citizenship.

Readers here will likely have seen a discussion of Baro’s “affidavit” which shows that it doesn’t say what people claim it does. Baro also copies and pastes some misinformation from the Internet including oft-reported, and easily proved false claims about Hawaiian law.  Sandra Lines cast no criticism specifically against the Obama Certification of Live Birth beyond her general statement that no document image on the Internet can be relied upon.

Then Orly presents some evidence I hadn’t seen before. I present this in its entirety:

I am back in Senegal and today was talking with someone who helped raise votes for Obama. We didn’t go into too much as I didn’t want him to become suspicious, but he said foreign money was sent through Western Union. Perhaps this would be an area to have investigated. He did say that he, like many others, is very disappointed in O.

Hope this helps. I’m praying for all of you on the forefront of this. May God give us a true breakthrough.

“Raise votes for Obama”? They vote for the US President in Senegal? So we have someone we never heard of claiming to have talked to someone, but not too much, and whose name is not given,… May God make your nose grow long if you are lying.

Then, as one might expect, Orly drags gives HER version of the recent loss of her web site and airs internal dirty linen:

My web master Lisa Ostella stated that such a report gives her, as a web master. bad name and demanded that I take the hacking report back. She stated that she was convinced that the changing of the e-mail address was done by a volunteer moderator Fran, she stated that she locked Fran from the blog and that should solve the problem. I felt that the matter needs to be investigated by the FBI and I felt that they should draw their own conclusions. Ms. Ostella stated that if I do not take back my complaint to FBI, she will no longer host my foundation on her server. When I found a new web master to host my foundation, Ms. Ostella instead of transferring the access codes and the domain, has locked me and another volunteer moderator out of the blog, posted a bizarre defamatory statement, that I supposedly authorized hacking into my own account and further defamatory comments about me were placed under different names and aliases. Moreover, there were comments posted supposedly under my name, even though I was locked out of the account and couldn’t respond. I got reports that some defamatory comments were made under alias usually used by Lisa Liberi, assistant for Attorney Phillip Berg, who filed similar legal actions. I started receiving statements and copies of pay -pal receipts, showing instead of my e-mail address, an e-mail address of Lisa Ostella. Originally, I thought that maybe her address showed on the receipt, since she was a web master on the account, however, when I checked the names and dates on the receipts against the names on the roster, that I downloaded earlier, I could see that those were not received by the foundation, those donations were missing.

It goes on with Orly exercising her well-known penchant for assuming two people with the same name must be the same person (remember Barakak Osama?) …

A couple of weeks ago I have received a phone call, providing information that Lisa Liberi, a paralegal, assisting Mr. Berg, has an extensive criminal record. I decided to verify that. According to Mr. Neil Sankey, licensed private investigator with 20 years of experience in Scotland Yard and over 12 years of experience in US, those statements were correct. Lisa Liberi aka Lisa Richardson aka Lisa Courville and other aliases had an extensive criminal record going back to 1990s, that included Grand Theft, forgery, forgery of seals “From 2000 to 2004, Liberi engaged in a complex fraud involving falsification of police reports, manipulation of credit bureau reports, loan fraud, and counterfeiting of court documents resulting in hundreds of thousands of dollars in losses to banks and credit unions.” (see attachment). Please see the report attached and reports relating to criminal conviction in San Bernardino California. Interesting fact is that Lisa Liberi was convicted recently, in March of 2008, she was supposed to serve 8 years in jail. Miraculously this 8 year jail term was reduced to probation and an order to repay the victims. When I added up all the restitutions in the conviction, it added up to 21,000 per month. Where is this money coming from? Who is paying it? And paying to do what? I have sent an e-mail to Philip Berg, alerting him to this matter, however I did not hear from him back. After I raised my concerns to other parties and they confronted Liberi, she tried to claim that it is not her, but another Liberi, that she lives in PA and the one convicted lives in NM, however several sources confirmed that she indeed lives in NM, they confirmed her date of birth and appearance as matching the ones on file with the San Bernardino, CA district attorney. I tried to analyze the instances when Liberi was the most vicious in her attacks towards me and found two distinct areas:
a. Obama’s Natural Born status and definition of it
b. my efforts to conduct investigation of illegal, criminal activity and my efforts to have FBI and attorney generals of different states involved.

There’s more, but I hope you stopped reading a long time ago.

Philip Berg

In a strongly-worded memorandum and order today, Judge James Robertson of the US District Court for the District of Columbia dismissed Philip Berg’s “interpleader” lawsuit, Hollister v. Soetoro. The court said: “I do have jurisdiction” dismissing the suit for failure to state a claim (since the interpleader claim had already been ruled “frivolous”).

Judge Robertson, who acknowledged that the issues raised by Berg were important on the bolgosphere and among conspiracy theorists went on to say:

The issue of the President’s citizenship was raised, vetted, blogged, texted, twittered, and otherwise massaged by America’s vigilant citizenry during Mr. Obama’s two-year-campaign for the presidency, but this plaintiff wants it resolved by a court.

But it gets worse for the plaintiffs:

Because it appears that the complaint in this case may have been presented for an improper purpose such as to harass; and that the  interpleader claims and other legal contentions of plaintiff are not warranted by existing law or by non-frivolous arguments for extending, modifying or reversing existing law or for establishing new law, the accompanying order of dismissal requires Mr. Hemenway to show cause why he has not violated Rules 11(b)(1) and 11(b)(2) of the Federal Rules of Civil Procedure, and why he should not be required to pay reasonable attorneys fees and other expenses to counsel for the defendants.

As we all know, defending these lawsuits has cost upwards of millions of dollars, and the consequences to the aging Mr. Hemenway (the DC attorney who signed the case, since Berg and Joyce are not admitted to the DC Bar) may be catastrophic.

Excerpts from the memorandum were posted by commenters earlier to day at Berg’s web site, ObamaCrimes.info. I wonder if they are still there.

That’s OK. Berg’s NEXT case is the good one. It’s sealed.

I was reminded today of Barack Obama’s comment during the campaign: you can put lipstick on a pig, but it’s still a pig.

Philip Berg is having a lot of trouble with the filing of his cases, overcoming his lack of standing, and fighting off judges who consider the lawsuits “frivolous”. Some have suggested the the basic problem is that Berg isn’t a very good lawyer and that he needs some highpowered assistance.

I think the essential problem Berg has is not with his legal skills, but that his allegations are no good. His “evidence” is nothing but unsubstantiated rumors and mangled citations of the law. The case can file interpleader, or Qui Tam or whatever else they come up with. They can get the best lawyer in the country, but in the end the case is based on a false premise. You can put lipstick on a pig, but it’s still a pig.

Mama Sarah Obama

I ran across the Saturday  Nation web site in Kenya today. One article from last October covered the dismissal of the Berg v. Obama lawsuit by Judge Surrick. It’s an informative article, but what fascinated me was the comments. In some ways they parallel what you’d see on a US blog with information and misinformation, but with a distinctly African twist. Some of the posters there thought Berg was black (and therefore not a racist).

Sample:

kamanikiole, just to set the record straight, this Philip Berg is not black, he’s white. That, and his law suit against Obama’s quest for president does not necessarily make Berg a racist. I suspect his action is driven by vindictiveness because Hillary Clinton, whom Berge supported in the primaries, lost. But I agree with your implied sentiment that NAACP membership doesn’t exonerate one of racial prejudice. Last point: the NAACP isn’t an exclusively black association. It’s an association for all people of color.

Another article was titled: Coming to America, by Sarah Obama. It’s about Barack Obama’s step grandmother, Sarah Obama, and her visit to the Inauguration. It’s a neat story and not what you’d see in a US paper.

Apart from Mama Sarah, other family members of President Obama who travelled to the US for the ceremony included Mama Keziah Obama, Mr Malik Abong’o, Dr Auma Obama, Mr Abo Obama and Mark and Bernard Obama. More than 15 clan members also travelled.

“America is very good but extremely cold. I had to wear very heavy clothing,” she said and in amusement added that for the first time in her life she wore trousers to keep herself warm.

During her stay, she met the president twice, first at the church where he attended a prayer service before inauguration. She chatted happily with her grandson, through an interpreter. “I did not have much to tell him though because he is aware of the task I placed on him to ensure Kogelo, Kenya and the whole world live in peace and development,” she said.

In a rather remarkable Op Ed letter, We are Increasingly Getting Ashamed of being Kenyans the paper laments the lack of a politician in Kenya of Barack Obama’s quality.

Another article, Kogelo awakes to new dawn describes the changes in President Obama’s ancestral village:

The road that connects it to the Kisumu-Bondo Road at Ndori junction is in much better condition, and the homestead of Barack Obama’s extended paternal family — which has become an almost familiar spot on the world map — is under 24-hour armed security.

Domestic and foreign tourists have been flocking to Kogelo to see the birthplace of the US president’s father.

Some lawsuits filed with the intent of proving Barack Obama ineligible to be president make arguments that Barack Obama’s 4 years in Indonesia somehow erased his American citizenship.

In Philip Berg’s case, Hollister v Soetoro, we see some Indonesian laws cited. These are not as easy to find as a corresponding US law would be, but your diligent Obama Conspiracy Theorist has come up with them.

A number of claims are made in the suit for which no documentation is offered, for example the statement “All Indonesian students were required to carry government Identity cards.” Without a source, it’s not possible to verify the statement. We can’t deal with those here.

Here’s the first Indonesian law reference from Hollister:

27 Indonesia did not allow foreign students to attend their public schools in the late 1960’s or 1970’s, and any time a child was registered for a public school, their name and citizenship status was verified through the Indonesian Government. See Constitution of Republic of Indonesia (Undang-Undang Dasar Republik Indonesia 1945), Chapter 13, Law No. 62 of 1958 (all citizens of Indonesia have a right to education). The school record, attached hereto as Exhibit “B”, indicates that Soetoro’s name is “Barry Soetoro;” his nationality is “Indonesia;” and his religion as “Islam”. There was no way for Soetoro to have attended school in Jakarta, Indonesia legally unless he was an Indonesian citizen, as Indonesia was under tight rule and was a Police State. See Constitution of Republic of Indonesia (Undang-Undang Dasar Republik Indonesia 1945), Law No. 62 of 1958. These facts indicate that Soetoro is an Indonesian citizen, and therefore he is not eligible to be President of the United States.

Looking at the paragraph we see these Indonesian law claims:

1. Indonesia did not allow foreign students to attend their public schools in the late 1960’s or 1970’s
2. any time a child was registered for a public school, their name and citizenship status was verified through the Indonesian Government
3. There was no way for Soetoro to have attended school in Jakarta, Indonesia legally unless he was an Indonesian citizen

No argument is provided for the truth of these claims save the Indonesian Constitution Chapter 13 and Indonesian Law No. 62 cited. Law No. 62 has nothing to do with education or identity cards, so we we’ll save that law for later. The Constitution Chapter 13 does talk about education. It says:

Chapter XIII. Education

Article 31

1. Every citizen has the right to education.

2. The government shall establish and conduct a national educational system which shall be regulated by law.

Article 32

The government shall advance the national culture.

Indonesian Constitution of 1945

Frankly I am at a loss as to how “There was no way for Soetoro to have attended school in Jakarta, Indonesia legally unless he was an Indonesian citizen” can be inferred from this article of the Indonesian Constitution. Further there is nothing about verifying identity.

Having struck out finding any valid application of the cited Indonesian laws to Berg’s claims, we move on to the next section.

28. Under Indonesian law, when a male acknowledges a child as his son, it deems the son, in this case Soetoro, an Indonesian State citizen. Constitution of Republic of Indonesia, Law No. 62 of 1958 concerning Immigration Affairs and Indonesian Civil Code (Kitab Undang-undang Hukum Perdata) (KUHPer) (Burgerlijk Wetboek voor Indonesie).

Better luck this time because Law No. 62 does deal with citizenship. The entire law 62 is too long to paste here, but a copy in English is on the UNHCR web site for your review.

The facts are that Barack Obama’s mother married an Indonesian national (Lolo Soetoro) and that they all moved to Indonesia when Barack Obama was 6 years old.

First, Berg’s argument is predicated upon “a male acknowledges a child as his son” which doesn’t seem to apply. It was never said the Lolo Soetoro fathered Barack Obama. This law if it exists (it is not part of Law No. 62) it would reasonably be analogous to an “affidavit of paternity” such as we have the the United States. I don’t see this language as applicable to an adoption (if indeed there ever was one). Law No. 62 lists who is an Indonesian Citizen. Most are not relevant. This one is of interest:

(1)A foreign child of less than 5 years age who is adopted by a citizen of the Republic of Indonesia acquires the citizenship of the Republic of Indonesia, if such an adoption is declared legal by the Pengadilan Negeri [state court] at the residence of the person adopting the child.

However, Obama was over 5 years old when he went to Indonesia so it does not apply. Law No. 62 says nothing about a child 5 years or older acquiring citizenship.

The rather complicated Article 3 is of interest. It says that a child cannot acquire Indonesian citizenship if it would create dual citizenship unless the child is able to renounce said citizenship (which an American child is unable to do).

(1)A child outside a marriage of a mother who is a citizen of the Republic of Indonesia or a child out of a legal marriage, but who has in a case of divorce been assigned to the care of its mother, a citizen of the Republic of Indonesia, who follows the nationality of the father, a foreigner, may present a petition to the Minister of Justice in order to acquire the citizenship of the Republic of Indonesia, if, after, having acquired the citizenship of the Republic of Indonesia, it possesses no other nationality or states at the same time to have released another nationality according to the procedure stipulated by the legal provisions of the country of origin and/or according to the procedure stipulated by the agreement on the settlement of the bi-nationality between the Republic of Indonesia and the country in question.

Of course there is no “legal provision” of the United States whereby a minor could release his US Citizenship. This is similar to 5h which also restricts citizenship to those for which it would create dual citizenship.

h.have no nationality, or have lost his nationality if the petitioner acquires the citizenship of the Republic of Indonesia or states at the time to have released another nationality according to the legal provisions of the country of origin or according to the legal provisions of the Agreement on the settlement of the bi-nationality between the Republic of Indonesia and the country concerned.

Article 7 deals with the options for Indonesian citizenship for Obama’s mother (probably not relevant but included for reference).

Article 7.

(1)A foreign woman married to a citizen of the Republic of Indonesia, acquires the citizenship of the Republic of Indonesia, if and when she makes a statement as to that effect within 1 year after contracting said marriage, except in case when she acquires the citizenship of the Republic of Indonesia she possesses still another nationality, in which case the statement may not be made.

(2)With the exception as mentioned in para 1 the foreign woman who marries a citizen of the Republic of Indonesia also acquires the citizenship of the Republic of Indonesia one year after the marriage has been contracted, if within that one year her husband does not make a statement as to release his citizenship of the Republic of Indonesia.

Said statement may only be made and only results in the loss of the citizenship of the Republic of Indonesia if by such a loss the husband does not become stateless.

(3)If one of the statements mentioned in para 1 and 2 have been made, the alternative statement may not be made.

(4)The statements mentioned above shall be made to the Pengadilan Negeri or the Representation of the Republic of Indonesia at the residence of the person making such a statement.

Again, the principle of no dual citizenship prevents the acquisition of Indonesian citizenship:

Article 9.

(1)The citizenship of the Republic of Indonesia acquired by a husband is automatically valid for his wife, except if, after the citizenship of the Republic of Indonesia has been acquired, the wife possesses still another nationality.

(2)The loss of the citizenship of the Republic of Indonesia by a husband affects automatically his wife, except if the wife will become stateless.

Next item from the lawsuit:

29. Furthermore, under the Indonesian adoption law, once an Indonesian citizen adopts a child, the adoption severs the child’s relationship to the birth parents, and the adopted child is given the same status as a natural child and the child takes the name of his step-father, in this case, Soetoro. See Indonesian Constitution, Article 2.

Following is Article 2 of the Indonesian Constitution:

Article 2

1. The Majelis Permusyawaratan Rakyat shall consist of the members of the Dewan Perwakilan Rakyat augmented by the delegates from the regional territories and groups as provided for by statutory regulations.

2. The Majelis Permusyawaratan Rakyat shall meet at least once in every five years in the capital of the state.

3. All decisions of the Majelis Permusyawaratan Rakyat shall be taken by a majority vote.

Doesn’t make any sense to me either. I’m beginning to think Berg is doesn’t know the difference between the Indonesian Constitution and Law No. 62 from 1958. Article 2 of Law No. 62 is quoted above and only applies to children under 5 years of age.

Next from Hollister:

30. The Indonesian citizenship law was designed to prevent apatride (stateless) or bipatride (dual) citizenship. Indonesian regulations recognized neither apatride nor bipatride (stateless or dual) citizenship. Since Indonesia did not allow dual citizenship; neither did the United States (since the United States only permitted dual citizenship when ‘both’ countries agree); and since Soetoro was a “natural” citizen of Indonesia, the United States would not step in or interfere with the laws of Indonesia. Hague Convention of 1930.

In this Berg starts correctly: Indonesian law is designed to prevent dual citizenship; however, it does so with the full acknowledgment of the laws of other nations. What Berg fails to take into consideration is the provisions of Indonesian law already in place (cited preceding) that deal with dual citizenship, and prohibiting acquisition of Indonesian citizenship in that case when dual citizenship would otherwise be created. Therefore, US Law which does not allow a minor to renounce their citizenship, in no way interferes with Indonesian law, and there’s no reason to invoke the Hague Convention.

The way the Hague Convention is interpreted by Berg seems to be “any time US law conflicts with that of another country, we lose” and that’s just plain silly.
