I think what they refer to is his status under the UCMJ (not USMJ) until he receives his DD214 discharge certificate. Until his appeals are complete he remains in the Army. He will be placed on unpaid appellate leave. During that time he is still subject to the UCMJ. That means he could be prosecuted under Article 88, UCMJ (http://goo.gl/4l02), for certain comments he might make about the president and others.

Let see if the Terry Lakin Action Fund is able to raise enough money to give him all the money he lost for disobeying orders. Now that he has served his time, maybe he will find a new hobby.
There’s a questron that I’m embarrassed to admit didn’t occur to me to ask until yesterday. Normally when a servicemember is confined, forfeiture of pay and allowances takes effect 14 days from the date of confinement. But a servicemember with dependents can ask the convening authority to waive automatic forfeitures and pay the servicemember’s pay and allowances to his dependents until the convening authority takes action. I wonder if MAJ Kemkes submitted such a request for waiver of automatic forfeitures and, if so, how the convening authority acted on it. If there was such a request and it was suceesfful, then LTC Lakin’s family would have continued to receive his pay until the CA approved the adjudged forfeitures, which I understand occurred on April 9.
I think I’ll be submitting some FOIA requests this weekend, though that isn’t exactly the optimal method to acquire information quickly.

I might have let that slide, but there were also messages that were inflammatory. The main criteria I use for banning here is to keep the discussion community functioning in a orderly manner (pausing to let the laughter die down).
That said, I concede that I’m not even-handed in the application of this policy. There are almost 92,000 comments on this blog, and I don’t have the time to spend with each one examining policy and comparing precedent. An established member of the community will get cut more slack than someone who barges in yelling at the top of their lungs; however, I think I’m going to have to do something about some of our established members who seem to be intentionally stirring the pot. I’m not embarrasessed, but did forget to consider post-trial deferral and waiver of forfeitures as a potential “clemency” action of the convening authority. The answer is that LTC Lakin did request deferment and waiver of forfeitures of pay while confined. The requests were denied. This denial is not unusual. Usually it is only the very junior troops with young children and a non-working spouse who get favorable consideration in a NG case. There are many more times there’s an approval if the person is pleading guilty and there is a pretrial agreement (plea bargain). There was no PTA in this case.
Now that’s emabaraseeing.

It would depend on the agreement between Neal and Lakin. I don’t normally contract to do the clemency part because usually I’ve done everything to put the mitigating matters in the record. I usually leave the clemency to the military attorney which does usually include a request for deferment and waiver of forfeitures. It’s a standard request whenever there is a wife and/or children. Not much “labor” goes into it. The biggest issue is getting a “budget” put together to show the convening authority the financial impact on the children..
Once again Lakin was ready and willing to accept the authority of the questionable chain of command when it would have worked to his financial benefit. Too bad he wasn’t forced to make that agonizing choice once more.

I am all in favor of facts, which is why the COLB and the Long Form are so relevant as they show, as other facts had already indicated, that President Obama was born in the US and thus a natural born citizen.
1. President Obama’s 2007 COLB shows him born in Honolulu Hawaii. The document contained all the necessary elements to be certified: Security background paper, a signature, a date and a raised seal.
2. The 2007 COLB was further supported through contemporaneous newspaper articles announcing President Obama’s birth, published August 13, 1961, 9 days after the birth.
3. The birth certificate was filed on August 8, 1961
4. The Department of Health of the State of Hawaii further validated that President Obama was indeed a natural born citizen through his birth on US soil.
5. School records obtained under FOIA, show that Obama Sr spent the summer of 1961 attending classes in Hawaii. The classes ended on August 8, 1961. This makes it extremely unlikely that he and his wife were in Kenya.
6. Immigration records obtained under FOIA, similarly show no evidence that Obama Sr left the United States while he was a student in Hawaii. Again showing that the likelihood that he and his wife were in Kenya, is extremely unlikely.
7. President Obama’s certified long form’ birth certificate indicates that he was, as expected, born in Kapiolani Hospital and that his birth was witnessed by an MD and signed by his mother. While some have argued that the pdf which showed Obama’s birth certificate to be fraudulent’, it was also revealed how the combination of compression and the separation of text and graphics into layers, can explain for the creation of layers when imported into Adobe.
8. The certified long form’ certificates were also certified in a separate letter, indicating that the creation and signing of the long form had been witnessed. The letter was then provided to President Obama’s private attorney who delivered it to the White House, maintaining the proper chain of ownership.

As to the Founding Fathers, yes, they are quite important when trying to understand the meaning of natural born.

It is a state-issued birth-certificate. A state-issued certificate is by definition real, just as a $100 bill issued by the Federal Reserve is by definition a real $100 bill.
Well, proof is somewhat of a strong statement. People have shown some misunderstandings as to how PDF’s work. But luckily we have additional photographs which lay to rest any confusions here.
And the long form certificate has been fully certified by the Department of Health of Hawaii, similar to the certifications by the former, Republican administration.
Now if you want to argue that the DOH of Hawaii somehow falsified the document then fine but I have seen no credible evidence of any kind of fraud so far.
Care to share these ‘facts’ on an open forum where they can be discussed?
I cannot change how you see the ‘facts’ but I can certainly point out the facts as are known to all of us which show that Obama was born on US soil. Now if the argument has evolved to claims that he could still not be NBC because he was not born to two US citizens, then we can explore that myth as well. It’s quite easily debunked but perhaps you would like to make your case on this forum?

While I don’t doubt that your sources are accurate (insofar as I looked at them), you do not present them honestly. An honest presentation is faithful to the context of the original source and deals with both sides of the issue. You have just cherry picked short quotations and strung them together to imply things that aren’t true.
Your video is not significantly different from any number of other web pages and videos that share the same dishonest treatment of historical sources.

As to the definition of Natural Born Citizen, the Courts explained in US v Wong Kim Ark that under our Common Law, with which the Founders were familiar, natural born meant ‘born on soil, regardless of the status of the parents’. This was why the Court in Ankeny v Daniels ruled President Obama to be a natural born citizen and thus eligible.

What I am hankering for is to have both sides put their best arguments and claims on the table and discuss in a civilized manner the pros and cons of the claims. Our KBOA friend appears to believe that her video proves it all and that the best ‘obots’ can do is lie about it or call it lies.
There should be some middle ground where one could explore in more depth the validity of her claims? I know, we have gone over many of the claims in the past but it would not surprise me to find out that our friend may not be fully familiar with them.
Of course, when she starts with the executive order myth then there is a lot of work to be done here but perhaps it can help he find out the facts in a more balanced manner? I was hoping that your site could serve as a place for a meeting of the minds so the speak. There appears to be a lot of anger on her part and I can understand part of it as she is facing quite a bit of nastiness from others although it is hard to distinguish cause and effect here.

And then Obama coming forward with the long form which by any reasonable measure should have settled it all. Nothing to ignore your view of Natural born citizen just didn’t exist before 2008. Its not in the civics books its not in any law books. Natural born citizen includes being born in the US regardless of the citizenship of the parents
We are better than those are we not? This has nothing to do with coddling but all with common courtesy and respect for other people’s arguments. In a case were both sides have been slinging insults, it is often hard to keep track of what started it all.
Sure respect has to be earned but can also be granted to those who are willing to discuss their thoughts on this blog. If you feel that the person does not deserve your respect you can freely ignore said person.
Otherwise you are granting such a person enormous powers over you as you feel necessary not just to ignore such a person but to return what you interpret as insults, with similar insults.
