Taitz files incoherent lawsuit

Orly Taitz filed another lawsuit on July 5 in the US District Court for the Central District of California, Taitz v. Sebelius (8:2012cv01092). The tricky part is figuring what the suit is about. It appears that Taitz has taken all of her old lawsuits and added them to new lawsuit, creating a confusing mashup of everything from the Affordable Healthcare Act to a RICO complaint against Hawaii vital records director Alvin Onaka.

The new part of the case is an equal protection claim that the Affordable Healthcare Act discriminates against Christians and Jews to the benefits of Muslims, which Taitz claims are exempt from the mandatory insurance coverage provision of the Act. That in itself is a dubious claim. The ACA does provide a religious exemption for persons whose religions prohibit insurance. The same is true for Medicare. Muslims, however, are not exempted from Medicare and so it makes little sense to assume that they would be exempted from the ACA. It would be more plausible to say the law favors the Amish, but Taitz doesn’t appear to be prejudiced against the Amish. Snopes has an article with more details.

At least that part I understand. But how does Sheriff Arpaio fit in? And how about the rest of these defendants:

  • NANCY PELOSI, IN HER CAPACITY AS THE CHAIRWOMAN OF THE 2008  DEMOCRATIC NATIONAL CONVENTION
  • BRIAN SCHATZ, LYNN MATUSOW IN THEIR CAPACITY AS 2008 CHAIRMAN AND SECRETARY OF THE DEMOCRATIC PARTY OF HAWAII
  • ALVIN ONAKA, IN HIS CAPACITY AS THE REGISTRAR OF THE HEALTH DEPARTMENT OF HAWAII
  • MICHAEL ASTRUE, IN HIS CAPACITY AS THE COMMISSIONER OF SSA
  • ERIC HOLDER IN HIS CAPACITY AS ATTORNEY GENERAL OF THE USA
  • WILLIAM A. CHATFIELD, IN HIS CAPACITY AS THE IMMEDIATE PAST DIRECTOR OF THE SELECTIVE SERVICE
  • ALICE TRAVIS GERMOND IN HER CAPACITY AS A SECRETARY OF THE 2008 DEMOCRATIC NOMINATING CONVENTION OBAMA FOR AMERICA

What is curious is that Taitz has filed the case as a private citizen rather than as an attorney, yet she seeks to have Christians and Jews certified as a class.

The unifying theme in the suit is, of course Obama. Taitz’ Quixotic quest to remove Barack Obama includes anything and everything she believes negative to him. So in her mind allegations of Selective Service forgery are valid objections to the Affordable Healthcare Act.

The 113-page complaint contains many attachments of the usual Taitz material: Arpaio’s Affidavit, Obama’s Indonesian school registration, Obama’s certificate of nomination from the Hawaii Democratic Party, Paul Irey examination of the long form and many more (for a total of 17). The only link I have to the case right now is at the Taitz web site.

And yet the birthers defend this mess. Particularly the conspirac-ish theory that Muslims are exempt (Obama is hooking ‘his people’ up! It’s what ‘they’ do!). They’re eating it up.

As flaming politcal invective, it’s classic. Poisonous, but brilliant. But in the form of a lawsuit? Being defended as a logical argument? Yeesh.

That’s right! Orly Taitz has lost her license to practice dentistry in California and if currently treating patients today, – she’s practicing without a license! But in fairness to Orly, allowing for her difficulties with the English language, an excuse for her failure to comply with the California dental license-renewing fingerprints requirement may be powerfully confirmed by DNA evidence still encrusted on one of her office’s reclining dental chairs, reminding us of that touching moment when Orly was convinced that her finger prince was Charles Lincoln the 3rd!

The only thing this filing is meant to do; distract from the utter failure of her Senate run. Since her Senate run was an attempt to cover her failure as an attorney, it has come full circle.

She is a parody of herself. Not even worthy of reality show celebrity.

I, for one, will leave her alone.

It is her worst fear. ( to be left alone by everyone; not by me.)

When she spoke at the Georgia ballot challenge I was struck by the fact that, when given all the time in the world, she couldn’t even state her case coherently and it had nothing to do with English not being her native language. It’s her whole life yet she can’t even explain why she thinks Obama isn’t eligible. She doesn’t finish one thought before going on to two other non-related topics. You would think she could memorize a 15 minute spiel to simply state her case but she just can’t do it.

Everything she says or writes outside of a courtroom is cleaned up for her by allies and by Birther watchers — “I guess she means . . .” and she has benefitted from that but, thankfully, that gets her nowhere with judges.

As I think was noted on the open thread, Taitz has moved for the judge to recuse herself in this case. The argument is that the judge was appointed by Obama, and one of several unrelated arguments in this lawsuit is that Obama is ineligible, and that would, in the birther fantasy world, imply that the judge’s appointment would be void, so the judge has a conflict of interest on this case.

I wonder if the judge will find this argument funny or just annoying.

This sort of harassment is rather like tormenting a neighbor by ordering pizza delivery, funeral flowers, topsoil etc. For Orly and her racist seditionist friends to have a venue for venting their insanity is one thing (free speech, if you like), but it is entirely inappropriate that her court-based nastiness is used to insult decent people, to lie, lie and lie about them, to cause them serious inconvenience, worry and expense.

Why isn’t she disbarred? Why isn’t she charged with some sort of criminal offense for her repeated lying in court?

Oh dear, the only possible explanation for those two issues is truly Orlyesque – this is clear evidence that Orly has corrupted the California Bar Association and many judges so they give her vicious nonsense a free run! There is no other possible explanation!! It is The Truth!!! Huge Orly Conspiracy!!!!

Here is where she comes from: Settler leader calls democracy an obstacle to Israel’s higher calling – Veteran settler leader Benny Katzover: ‘We didn’t come here to establish a democratic state.’
    http://www.haaretz.com/print-edition/news/settler-leader-calls-democracy-an-obstacle-to-israel-s-higher-calling-1.407490

Settler leader: Democracy must be dismantled – Haaretz reports that settler leader Benni Katzover calls for dismantling democracy and “bowing to Judaism,” and the leader of the right-wing coalition aids “price tag” activists. Can we discuss the treason of the right yet?

The veteran settler leader, Benni Katzover, was caught…telling some meshigene Chabad paper, “Beit Mashiach”, that “I would say that today, Israeli democracy has one central mission, and that is to disappear. Israeli democracy has finished its historical role, and it must be dismantled…”

Referring to the struggle against gender exclusion, Katzover sailed on the seas of conspiracy, saying, “The leftist activists are cooking timed campaigns against anything that smells of holiness…”

Katzover gains a point for no longer pretending, as most settler leaders still do, that he values democracy. Religious Zionism, as that pig who shows his cloven hoofs so that people will mistake it for a kosher animal, always claimed to support “Jewish democracy.” As anyone who actually studied in that world knows, democracy is described there as a Greek construct, alien to Judaism. When democracy is spoken of, the rabbis kept mentioning the biblical injunction “thou shall not follow a multitude to do evil.” It would be interesting to know how many settler leaders think like Katzover, but do not, as yet, dare say so openly.
