The third alternative

When at first you don’t succeed, try, try again.

That seems to be the birther motto, but I think the familiar saying above implies trying for the same goal using different means, not repeating the same exact failure. Nevertheless, that’s what activist birther attorney Larry Klayman and an Ocala Florida Tea Party group who have “indicted” the President, Vice President, Attorney General and Chief Justice for a list of stuff the group, styling themselves a “grand jury,” came up with, reports Ocala.com. Lest we forget, the Ocala Tea Party indicted Obama and Biden already, back in October of 2012. How did that work out?

I believe what [Klayman]’s doing is the right way to go about making the federal government responsive to the people,” Tea Party Solutions President Stephen Hunter said. “There’s two alternatives: 1776 all over again or complete capitulation to a communist, socialist society.”

There is a third alternative: voting in a new president and petitioning Congress to impeach officials who have committed high crimes. Representative democracy does not mean that everybody gets their way.

Chief Justice Roberts was “indicted” because he refused to force Justice Kagan to recuse herself, something that he is not empowered to do under the Constitution. Surely at least Larry Klayman knows this, and this these indictment are a sham in the worst possible way. As one federal judge said:

Any self-styled indictment or presentment issued by such a group has no force under the Constitution of laws of the United States.

Responding to his critics, Klayman said:

What do you expect from atheists and ultra-left wing socialists who hate conservatives and people of faith?

I would expect them to ignore the law, convene fake grand juries, and tell lies about their opponents. Thanks for asking.

People for the American Way research director Josh Glasstetter said of Klayman:

If they took the time to look, they’d find a long record of scandal, failed lawsuits and outlandish claims that never panned out.

    The Catch-22 for birthers is that one of the required elements of treason is that the defendant must owe allegiance to the United States. A foreign usurper cannot be convicted of treason against the United States.

    We’ll definitely see some more creative attempts to justify an eligibility challenge based on some Greek philosopher saying that wimmin can’t be Prez, or that the Constitution precludes it by exclusively saying “he” when speaking of the President.

    Or that she is ineligible for having served under an ineligible black guy, or wearing a dress during inauguration.

    Now that Pandora’s box is open, anything (crazy) goes!

    And they are ignoramuses. They don’t know the elements of treason. They think that Communism and Socialism are the same thing, and they don’t really understand either of them, just like they know very little about the Constitution.

    They remind me of Lynn Westmoreland, the Georgia Congressman who wanted the Ten Commandments posted in the House and the Senate. He was being interviewed by Stephen Colbert, who asked him to name the Ten Commandments. Westmoreland could only name three of them.

    I wonder if the birthers will transmogrify into Art II Sec 1ers if Hillary Clinton does run and win. After all, it clearly says “The executive Power shall be vested in a President of the United States of America. He shall hold his Office during the Term of four Years…” The Framers didn’t use those male pronouns by accident, right?

    Doc, thanks for posting that link to Klayman’s article about the Jewish intelligentsia; I hadn’t seen it and really didn’t know much about Klayman before. What a twisted anti-Semite who ironically accuses Obama of hating Jews and also hiring too many… People like Klayman are really dangerous and upset me, though I know I shouldn’t let them under my skin….     Klayman actually sued his own mother, and took it to trial. He owes thousands in child support. He joined Jews for Jesus, and says he’s still Jewish – a Jewish Christian. He’s a Christian anti-Semite.

    First Larry Klayman sued Hillary Clinton. Now he’s suing his mom…Klayman did not dispute the fact that he is suing his mother, Shirley Feinberg. He claims his mom won’t pay him back $50,000 he spent on private nurses for her mother, his grandmother, Yetta Goldberg, who died last August at 89.
