A commenter pointed me to a message from Carl Gallups on Facebook, posted just a few hours ago:

We spoke with Carl Gallups. Here is what he told us concerning this matter:

“I have spoken at length with Mike Zullo. He says that he and the sheriff are still proceeding with the investigation and their plans to release the information. They believe it will be soon. HOWEVER, as reported before – they have been involved in jumping some huge legal hurdles that will enable them to bring this info forward. They are still involved in one big legal hurdle now. They hope to have it resolved soon. Any major movement in the case coming forward will be announced on Freedom Friday with Carl Gallups (carlgallups.com) and on the PNN internet network.”

Gallups later posted at 5 PM that Zullo would be on the show at 5 PM. You COULD have given a little advance notice, Carl. So that will be something to listen to.1

What Gallups said about legal hurdles is a reprise of what he’d said half a year ago (except for the “s” word):

Carl Gallups: Been talking to Mike Zullo. Both the birth certificate and criminal investigations are still ongoing. Sheriff Arpaio is getting close to holding the press conference. They are in the process of getting over two legal hurdles so they can release some of the information. All sources and information must be extensively vetted.

For the boy who cried “wolf!” one too many times, the word lost its meaning through misuse. The same might be said of the word “soon” coming from Mike Zullo and Carl Gallups. My favorite example comes from February 7, 2014:

Gallups: You’re guys are confirming that you are very, very sure, very sure you know who several of these people are. …

Zullo: Yada, Yada, Yada. … This is going to be their play: deny, deny, deny.

Gallups: Right, but, but, they’re lying, lying, lying because you’ve got the goods, right?

Zullo: I’ve got the proof, proof, proof.

Gallups: OK, good. And the whole world is gonna see it, see it, see it, real soon.

In a video posted in May 2014 (and subsequently deleted) Gallups said:

So, we’ll know soon exactly what’s going to happen. In the mean time, from time to time Mike Zullo and I will give updates so that you will know that it’s still in the works, and still going to happen. God bless you.

We all remember the expectations of a “March reveal” in 2014, but even then birthers, like Mark Gillar, were prepared to give the Cold Case Posse a little breathing room:

… Don’t focus on a timeline. As far as I’m concerned as long as it breaks by summer and impacts the 2014 midterms, I’ll be happy.

Was 2014 the year of “soon”?

No, it started way before that. This is from Gallups January 2013:

PPS has been in direct contact with the Sheriff Arpaio investigation. We have just again been assured by Lt. Mike Zullo lead investigator that the investigation and potential angles of prosecution are still going full steam ahead. Just because it’s not in the news right now does not mean they are not feverishly working on the matter. There could be some big announcements in the case soon and forthcoming.


1We would be better able to track the delays if we had transcripts of the Gallups/Zullo segments. I made a few partial transcripts of them for articles, and I will continue to do that. Zullo has been on many times.

    I honestly think Gerbil Report’s admin is losing the faith. I say this because he is trying EXTRA hard to rehash this latest “Gallups Who cried Wolf” story as hard as he can, and as many time as he can. No less than three “new” articles about it. Almost like he’s really trying to convince himself that it’s going to happen…any day now, but he just can’t quite believe like he used to.

    Also spotted Doc posting this in the comment section of one of said articles
    “You need me much more than the commenters on my site do.”

    I think the answer to Rickley’s question is that that’s the “big legal hurdle” they refer to. They first have to write the statute. And oh, yeah, amend the Constitution to add a few requirements to be president. Like “white”. And to prepare for the next election, “male”.

    The “big legal hurdle” would be to convince SCOTUS that the Constitution never meant anyone except white men to be President to begin with.
    It probably goes something like this: “Blacks/women needed an amendment to even be able to vote, so they need an amendment to become President and there is none”.

    I already mocked them on Twitter how “A/Z are just crossing the t’s and dotting the i’s” suddenly became “need to overcome several big legal hurdles”.

I think Gallups has a big wheel with phrases like “the investigation has gone dark”, “crossing the t’s and dotting the i’s”, “It has gone in unexpected directions”, “universe shattering information” on his wall. He gives it a spin every few weeks and he knows that will keep the morons at GR happy for another month.

    The tone in Gallups’s voice can be more revealing than the words he speaks. The last time I heard him talk on this subject, he sounded like a man deep in debt to the wrong kind of people. “Now, calm down, Vito, no need for the brass knuckles. I’ve got your money! I just need a little more time to get it together. Please don’t hurt my beautiful face. I’ve got your money!”

    Then he started talking about Obama’s alleged “crimes” and his tone turned to anger, the fire-and-brimstone Southern preacher. Blackened sky and eyes glowing red. His Spirit Animal is surely the Cornered Weasel.

    I believe there is a special place in Hell already reserved for Carl Gallups.

    I think the legal hurdles include: federal judges, the IRS, the DOJ, and any number of other actual legal fiascoes Zullo and Arpaio must have to focus on… Then, of course, there’s the lack of jurisdiction, lack of evidence, no authority or probable cause for anything,.. Legal hurdles, indeed.

    Of course, the last thing Gallups and Zullo want to address is why anything that they have alleged would be a crime which would fall under the jurisdiction of Arizona in general and Maricopa County in particular.

    When I wrote the petition to request Sheriff Arpaio to investigate the Obama birth certificate I gave the following Arizona Revised Statutes that I believed gave Arpaio the authority to investigate a possible crime. The statute quoted in my petition was A.R.S. 13-2407 A-C, which declares that tampering with a public record is a class 6 felony. This is what my original petition request was based on and Sheriff Arpaio initiated the project based on my petition that contained 242 signatures.

    Facts that should be noted:

    1.) Arpaio and the resources of his office did not do the investigation as I requested. Arpaio turned the “investigation” over to volunteers of a non-profit corporation called the Cold Case Posse.

    2. The Maricopa County Attorney Bill Montgomery said in 2012 that he had no jurisdiction; that he had reviewed all of the Cold Case Posse “evidence” and classified it as “speculation.” And finally he said that it would have to be proven that President Obama was not a U.S. citizen.

    3. In my opinion, if the Maricopa County Attorney had no jurisdiction then it follows that Sheriff Arpaio had no jurisdiction to investigate President Obama ‘s birth certificate.

    4. When the State of Hawaii issued the certified Verification of Birth, in May of 2012, authenticating all of the details on President Obama’s birth certificate it did the following:

    It proved that President Obama was born in the United States and is a U.S. citizen.

    It proved that the birth particulars on the PDF copy of the Obama birth certificate were authentic had not been tampered with and therefore there was no violation of Arizona Revised Statute 13-2407 A-C.

    No alleged crime, as specified in my original petition to Sheriff Arpaio, had been committed. In my opinion, that should have ended the birth certificate investigation back in May of 2012.

    At no time has Pastor Carl Gallups ever spoken with me to determine how I started the investigation or under what Arizona Statutes I made the request to Arpaio.

    In any event, HI having certified, and then later verified, repeatedly, the document in question, which moved it well out of the realm of questionable, not that it had ever really been there to begin with.

    “13-2407. Tampering with a public record; classification

    A. A person commits tampering with a public record if, with the intent to defraud or deceive, such person knowingly:

    1. Makes or completes a written instrument, knowing that it has been falsely made, which purports to be a public record or true copy thereof or alters or makes a false entry in a written instrument which is a public record or a true copy of a public record; or

    2. Presents or uses a written instrument which is or purports to be a public record or a copy of such public record, knowing that it has been falsely made, completed or altered or that a false entry has been made, with intent that it be taken as genuine; or

    3. Records, registers or files or offers for recordation, registration or filing in a governmental office or agency a written statement which has been falsely made, completed or altered or in which a false entry has been made or which contains a false statement or false information; or

    4. Destroys, mutilates, conceals, removes or otherwise impairs the availability of any public record; or

    5. Refuses to deliver a public record in such person’s possession upon proper request of a public servant entitled to receive such record for examination or other purposes.

    B. In this section “public record” means all official books, papers, written instruments or records created, issued, received or kept by any governmental office or agency or required by law to be kept by others for the information of the government.

    C. Tampering with a public record is a class 6 felony.”

    I can’t for the life of me figure out how an image posted on the internet from the White House satisfies ANY of those conditions, especially as an offense committed in Maricopa County, Arizona.

Since the BC was not an AZ public document, there was no authority for the Shurf to even look at it.     I could see Arizona having jurisdiction if someone used a forged or altered out of state document to obtain an Arizona driver’s license or apply to vote in Arizona, or something else along those lines.

    However, to my knowledge Obama has never used his LFBC for any official purpose in any state, much less in Arizona.

    That is NOT a problem with A.R.S.13-2407.

    It is a problem FOR ‘forgery-minded’ Birthers, for sure, but not with the Arizona law.
