Arpaio seeks to avoid federal contempt hearing

Admits wrongdoing

FLASH UDATE: APRIL HEARING IS STILL ON!

According the Arizona Republic web site, Judge Snow says the April contempt hearing is still on. A settlement is possible if plaintiffs agree to terms, but the judge wants Arpaio to admit in open court his wrongdoing, and to pay money out of his own pocket.

H/t to the Stephen Lemons and the Phoenix New Times Blog for this story that interested readers will want to get from that source.

In a few words: Arpaio was scheduled to face a 4-day civil contempt hearing in April in the Melendres v. Arpaio case. The court ordered remedies after finding that Arpaio and his department were engaging in racial profiling. Arpaio has not obeyed the Court’s orders. Seeking to avoid a hearing (what Lemons calls a “de facto trial”), Arpaio has filed papers with the court “consent[ing] to a finding of civil contempt.”

The Shurf is trying real hard NOT to end up on the wrong side of a deposition that could bring his entire house of cards down around his ears, and the Feds don’t want to play.

  2. Yoda says:

I would love to see a hearing related to all of his abuses of power, including dragging the used car salesman in to testify about the “investigation” and the fianances. They would both end up in jail. Of course birthers would say that the are political prisoners. But justice would be served.

  3. alg says:

Sheriff Joe’s admission of guilt is the beginning of the end for him. Count on calls for him to resign to intensify. What’s truly absurd is that he’s asking Maricopa County to pony up $350,000 to keep him out of the courtroom. The ask alone will doom him. It’s one thing to be the unrepentant victim of “injustice” by the federal government. It’s an entirely different thing to publically admit guilt but ask the public to pay the fine.

  4. Curious George says:

It’s time that the Shurf experienced some tough love. This could become very interesting.

  5. Punchmaster via Mobile says:

Maybe they think that if they ignore this, it’ll just go away.

Unfortunately, I’m not that confident. Many of his constituents seem very comfortable with ignoring his multiple transgressions, and will easily except the line that all this is some liberal plot to go after him.

I would happily accept being proven wrong.

He’s in his 80s. One way or another, he won’t be long for that job.

  8. Curious George says:

Do I see a trend developing? Mikey admits to taking a $10,000 “gift ” from a source. Now Mikey’s boss admits to civil contempt of court. Will an admission of criminal contempt be forthcoming? Will Republicans admit they were wrong about Joe and demand Arpaio’s resignation? Turn on the popcorn machine, and enjoy!

He has cost the folks of Maricopa County something in excess of 44 Million dollars in legal costs, fines, sanctions, lawsuits etch never mind the estimated 22 Million for the additional requirements since the judge slapped him with monitors etc.

All wasted money, none justifiable, all out off the pocket of the MC electorate and yet the blue rinse brigade, most of them on fixed incomes still love him….. Makes no sense……….. 8-(

Silly question. Of course he has no shame.

Let us hope the voters of Maricopa County develop some soon and decide to send him into retirement.

Given his declining vote margins in the last couple elections combined with these developments I see it as a real possibility.

You know something odd? I haven’t noticed Mad Magazine lampooning the birther industry.

Actually, I guess its not odd since I’ve only looked at maybe two issues in the last 30 years, but I bet some of the readers here read it more often than that and would have said something about it.

EDIT: Mr. Google is my friend.

Wow, I just read today’s AP coverage of this situation, and I think you are correct; Joe’s running scared and the Judge is angry and apparently considering launching a criminal investigation of this matter.

    Read at http://tinyurl.com/ocprl72

I don’t see how the Birthers can successfully spin Joe’s admission of wrongdoing as trumped up Obama administration charges!

And I don’t see how Arapio’s cheer leading, voting fan-club of local citizens can insulate him from an honest and brave torch-bearing judge!

This could be Joe’s serious undoing.

They can’t spin this because look at the obvious fact that they’re totally ignoring this — They’re all on board with the retired SC teachers’ crazy rant with Santorum.
They need some new cray-cray and ‘Man, did she deliver’ !!

What personal skin is Arpaio willing to give?

Judge wants Arpaio to admit that he willfully disobeyed court order.

Judge’s orders to be complied with.

Judge may recuse himself if criminal contempt charges are pursued.

The problem is that Arpaio’s supporters are so insulated from reality, that they can’t comprehend what is happening. Their glorious A/Z day will never be realized. It’s tough to take, but hopefully the Arpaio zealots will someday recover from their acute case of cognitive dissonance. It’s really tough to be a Birther today. The video at that link has the reporter putting the taxpayer cost of defending Sheriff Joe in this racial profiling lawsuit at $6.8 million. Members of the Maricopa County Board of Supervisors are calling for the Sheriff’s resignation.

  31. Judge Snow wants this penalty to come from Arpaio’s pocket, not his legal defense fund. How does $100,000 sound?

  32. Curious George says:

This is just too good to ignore. An excerpt from “Mighty Dawg” at Fogbow:

“But using one’s official position [Arpaio’s position] to “investigate” a federal judge that is presiding over the civil trial the Sheriff is a defendant in is a truly serious matter. It reeks of retaliation and criminal contempt. And, unlike locally elected officials and judges, a federal judge isn’t subject to or tempered by the political will of the local community. Interestingly, Judge Snow has already said if the April hearing results in criminal contempt charges he would recuse himself from presiding over that trial. There are sealed documents that have yet to be disclosed publically but likely will become public at the civil hearing in April. Perhaps these involve the Dennis Montgomery affair and both the Sheriff and Judge Snow already know what’s coming.”

Well said Mighty Dawg. I hear a huge puckering sound coming from Arpaio supporters over at Gerbil Report.

  33. Mark McDaniel says:

The thing that concerns me most is that Zullo and Gallups have both claimed, on multiple occasions, that they knew the identity of the forger, and then Sheriff Joe comes out, on multiple occasions, and said that they did not know who did it, and since then we have had no news conference from Zullo. What this suggests to me and my law enforcement contacts, is that Joe has been threatened/compromised, and he is actually trying to communicate that by his bizarre contradictory public statements. The question is, how damn long will the supposed supporters of Team Arpaio take before they actually realize that Joe has been threatened/compromised? And what action will they take? I see nobody at BR even bringing this subject up, which indicates to me what a bunch of losers they are in their Epic Fail Mission

  34. Krosis says:

Wow! Finally, a first suggestion that Arpaio had been bribed or threatened!
Or maybe it’s an investigation in reverse. For the CCP, time runs in the opposite direction from us.

  35. bovril says:

    Mark dear boy,

Piehole has not been ‘threatened’ or ‘compromised’ as your imaginary law enforcement contacts whispered to you.

He lied, pandered to his base, got taken by a con man and is desperately attempting to deflect folks from looking at his illegal and unconstitutional actions over the last decade.

That, along with his arrant arrogance and credulity is the root of his “bizarre contradictory public statements”.

  36. CarlOrcas says:

Mark McDaniel: What this suggests to me and my law enforcement contacts, is that Joe has been threatened/compromised, and he is actually trying to communicate that by his bizarre contradictory public statements.

    Utter nonsense.

The only thing that has compromised Joe Arpaio is Joe Arpaio.

What this suggests to me and my law enforcement contacts, is that Joe has been threatened/compromised, and he is actually trying to communicate that by his bizarre contradictory public statements.

What this suggests to any rational thinker is that neither Zullo nor Gallups nor Arpaio has any idea who “the forger” is, for the simple reason that there is no forgery.

We’re closing in on the anniversary of Zullo’s failure to release his “universe shattering” information. What does that tell you?

  39. Curious George says:

    Mark McDaniel
“The question is, how damn long will the supposed supporters of Team Arpaio take before they actually realize that Joe has been threatened/compromised?”

This really is too funny for words. Birthers can never believe that their chosen saints are not really saints. This little problem is owned by Arpaio.

  40. Notorial Dissent says:

In more polite terms it’s called not being able to keep your lies straight or keep track of them.

The Klown Kommandant and Kid Giddyup are quite simply lying for the very simple reason that there never was a forgery of the birth certificate for there to be a forger. The certificates came directly from the HDH and were certified by them, both at the time, and later on repeated occasions. There was NO certificate to forge. Therefore the Klown Prince and Giddpyup are doing what they do best, lying.

    bovril:

  41. RanTalbott says:

Mark McDaniel: The thing that concerns me most is that Zullo and Gallups have both claimed, on multiple occasions, that they knew the identity of the forger

I believe that’s incorrect: Zullo and Gallups claimed to be “close” (using various terms) for a while, and I know of at least one occasion where Gerbil Report falsely titled a video claiming Gallups said they “knew” when he hadn’t.

There was also a video in which Gillar (iirc) said “We know who” using some garish title-dissolve special effects.

But Arpaio said in a recent interview that they had some “leads” that “didn’t pan out”: https://www.youtube.com/watch?v=sWuQgCgpBdQ

Also noteworthy: when asked about the Selective Service “forgery”, he replied “We’re not pushin’ that”. Which I interpret as meaning that someone finally explained to them that their fairy tale isn’t even “proof” in the vernacular sense, much less admissible “evidence”.

The sky is falling over at Birther Report over Cruz’s announcement to run in 2016, but it is still quiet concerning Arpaio’s contempt of court. I would have thought that they would be screaming bloody-murder about President Obama’s “obvious” blackmail of the Sheriff by now.

  44. Punchmaster via Mobile says:

I am enjoying the HELL out of the mass tantrum going on over there.

  45. Curious George says:

Hey Gerbil Report, your super hero Joe Arpaio is under attack!!!! He’s going down in flames and you’re doing nothing to help him! I know, recycle some three year old Joe articles with a current date. That’ll get the braindead feeling great. No worries mate. All is well……

Whatcha gonna do when Joe calls for you? (Crickets chirping in the distance.)
