Klayman out, DOJ in, Mackiewicz in deep, and more hard drives?

OK now we know why a portion of the prior hearing in the Melendres case was sealed. It’s unsealed now, and involves Defendant Brian Mackiewicz, who is revealed to be under criminal investigation. This according to a Tweet from reporter Stephen Lemons. All we know for sure is that MCSO spokesperson Lisa Allen confirmed that there was a criminal investigation by the Phoenix Professional Standards Bureau, but declined to reveal the issue. Sources say that has to do with irregularities in his overtime pay. Mackiewicz is on administrative leave.

In the meantime, the US Department of Justice has been allowed to intervene in the Melendres case (this related to settling another DOJ lawsuit with the County and the Sheriff), and Larry Klayman’s application (following his failure to show up to answer questions) to appear pro hac vice representing Dennis Montgomery and Mike Zullo has been denied. You can read Klayman’s previous reply to Plaintiff’s objections.

There’s likely not much to the hard drive story, but the Phoenix New Times received photos of a computer recycling truck loading equipment from the Maricopa County Sheriff’s Office August 6. The hard drives were supposed to have been removed first, but the Court is concerned.

    Zullo found! Apparently Zullo made a recent guest appearance before the US District Court monitors according to the most recent Stephen Lemon’s Phoenix New Times article posted this morning about the status conference held yesterday before Judge G. Murray Snow. Oh, to be a fly on the wall!

    Actually, he showed up for his interview with the monitors, but begged off due to not having yet hired an attorney. Plaintiffs’ counsel has named him as a possible future deponent.

    But great job anyway. I’ve not been over to see if they’re excited he might spill the beans to the monitor and in his (perhaps) upcoming deposition.

    I wonder if Zoo Low actually remembers all of the statements he has made publicly to Karl while he was trying to excite the donors. He may think he doesn’t have to tell the monitor about “birthing-related” facts that he made up, never expecting any one in authority would pursue such lies to expose them as false.

    But in the context of this enlarging REAL investigation, Obots will surely tattle on any inconsistencies between his relatively obscure Birther footprints, and any sanitized version he sobs to the monitor, AND those made-up “facts” may be very tricky to deny, and then recall and admit to, as having been deliberate lies made up for the Birther audience.

    Zoo Low has to be scared hapless as he ponders staying afloat with the sound of the falls he seems headed for getting louder and louder. He and Our Pie Hole are dangerous to each other, and I’ll bet they can’t even discuss their relationship anymore.

    You mean like him telling Carl on the radio just last month that “legal issues” were keeping them from revealing the “universe-shattering evidence” at almost the very minute the court was unsealing emails showing that he had known for months that he’d been scammed by Monty, and that evidence had never existed, and never would?

    My money is on this having been the last time Zullo ever showed up on Freedumb Friday. He basically said “We have super sekrit problems with our super sekrit everdunce that we might never resolve, kthxbye”, none of the any-day-nowishness he espoused all the times he talked about that before.

    That’s a pretty good habit. One I try to cultivate is to never take anything a birther says at face value. Saves a lot of time trying to explain something that never happened in the first place.

  38. I notice that Larry Klayman applied before for Pro Hac Vice in Arizona Superior Court in the case of Wise v. Bennett from 2013 that sought to quash the movement to recall Sheriff Arpaio. The Arizona attorney was David Burnell Smith, an Arizona state representative. One plaintiff was Jeff Lichter, an active Surprise Party Patriots member, and supporter of Mike Zullo.

    And the Arizona bar investigated Klayman, but nothing seems to have come from that investigation.

    Iirc, there was a later story about that. Klayman was supposed to file some paperwork with the state bar in connection with his PHV petition. He claimed he had given the papers and fee to his local counsel, who screwed up and didn’t mail them. I think they dropped the matter after deciding it wasn’t a deliberate violation.
