Orly is now claiming a victory. The court changed the docket entry from “tentative” to “final.”
She and the entire birfer world are assuming this means the Motion to Dismiss has been denied.

As an American that had a family member fall in every war this country has engaged in since the Spanish-American war, I can’t even begin to state how offended I am by that statement
Same with me. My family traces back to the AR and is very diverse ethnically. My 90 year old grandmother voted for Barack Obama and is proud of that fact! I thought America was about the freedom to have individual thought and ideas??
I am amazed at the willful ignorance of some of these people.
Let’s suppose Judge Carter did deny the MTD, what would happen then?
The government would appeal to the 9th Circuit, who would probably schedule a hearing in January which, if there were no delays, would lead to a decision in March or April.
Then, if the 9th Circuit upheld the denial of the motion, the government would appeal to the SCOTUS, who would set a hearing for the Fall, with a decision likely in March of 2011.
Presupposing that the 9th and the USSC upheld him, the earliest that this case could possibly get back to Judge Carter for (discovery and) trial would be the summer of 2011, yet some of these loons are believing that it is imminent!

I read over at politijab that one of their members thinks she’s onto the links from the GOP through Corsi to Lucas. Sounds like conspiracy theory, but those politijabbers are almost always right. I’ve always thought the neo-cons like Cheney, Bolton and Kristol were stirring the birther pot from afar, but to uncover proof the FKBC came from the GOP would be sweet.

The 9th has a huge caseload…it has taken Berg almost a year to get his case through the 3d.
Keep in mind how Politijab works. They post ideas and then criticize them. It is through the fire of debate that they arrive at some solid stuff. That doesn’t mean that every theory posted there has merit.
The Government may or may not be able to appeal. An appeal from the denial would be interlocutory, that is, made while the trial is still pending. In general, no appeal can be made until the trial is over. In exceptional circumstances, there may be an interim appeal, if the District Court or the Court of Appeals allows it. If the MTD were denied, it would be a good case for interlocutory appeal, since so much depends on the interpretation of the law.
All this is hypothetical. The MTD will most likely be granted. The plaintiffs themselves will then appeal. It would be up to the 9th Circuit to determine if the appeal should be expedited. If not, there could be a long wait.

Birther or not why would you want to support a president who refuses to release ANY of his records? I don’t care where he was born, but I find it arrogant to refuse the request of the American people when all they want is to see your long form birth certificate. I mean I have a copy of mine in my wallet. Why would a U.S. citizen just plain refuse to show their birth certificate? And he is spending tax payer money upwards of 1 million dollars to fight these cases. It just seems absured to me. I liked him at first, but now I am beginning to question his decision to fight this. a certificate of live birth posted on a website really isnt legal. I wouldnt direct my empolyer to a website to confirm my place of birth and Obama is insulting all of us by doing so. He thinks that we are all so stupid that we will not find out that the issue is wether his certificate of live birth is a delayed filing or was filed at the time of birth in the US. Like Obama or not don’t you think its wierd of him to seal all of his records? no other president in History has EVER done that, so ask yourself what is he hiding? That is just common sense to me and where is the conspiracy? I think what people are saying is that Obama is a liar. Not that anyone conspired.

The Certification of Live birth is the official document issued by the State of Hawaii. If you were Hawaiian and ordered a birth certificate today, that is what you would be carrying around in your wallet. The fact that you say the president hasn’t released ANY of his records, when the central document for the purpose of presidential eligibility has been released suggests to me that you have a disconnect with reality.
