Sheriff Arpaio swears: birth certificate “investigation is not yet done.”

Phoenix (3TV) reported yesterday on a deposition given by Sheriff Arpaio this past July in a lawsuit against him for malicious prosecution.

America’s toughest sheriff doesn’t seem to have a very good recollection of what goes on in his department, based on the number of times Arpaio couldn’t answer questions, but he is sure of one thing: the birth certificate “investigation is not yet done.”

  1. I don’t think they want to have to return the monies to their donors so they keep repeating this old mantra. However, the BR bloggers are finally starting to wake up to reality. On a side note, BR is inaccessible once again. I think someone should get to Volin and tell him to pull that [redacted. Doc.] out of his arm long enough to correct it.

The delicious irony is that the Birther BS led Arapio to Montgomery and it was his failure to preserve evidence from the Montgomery BS investigation that largely led to the criminal contempt order. We should all give a big thank you to Mike Zullo and Montgomery for the role they played in getting Joe up on criminal charges.

    Yes, it all goes back to that glorious birth certificate investigation that will ultimately bring down Arpaio and Sheridan and hopefully, Zullo will be looked at with great interest for bringing in and backing the guy who, according to court transcripts, defrauded the MCSO.     There can be no defamation for something an attorney says during a court proceeding. It’s called Litigation Privilege. Look it up.

    Also look up the difference between libel and slander.

    Perhaps if Judy tried reading, he would know that the “crazy” comment (which, as noted, is protected by both the First Amendment and litigation privilege) occurred in the Flake case. Which has nothing do with Montgomery, the criminal contempt referral, etc. The only commonality is Arpaio’s abuse of his position.

    As usual, you compare apples and oranges. If you had bothered to go beyond simply doing a Google search, you would see that in the case of Edelman, Combs and Latturner v. Hinshaw and Culbertson, a legal memorandum which allegedly defamed a law firm was intentionally distributed to parties who had no connection to the litigation. That was the basis for the Court of Appeals ruling that the litigation privilege did not apply.

    That is entirely different from an off the cuff remark made by an attorney in a courtroom during a court proceeding.

  23. What it opens up is something I told a few people over two years ago. The end of the “posses.” Oops….look what just reportedly happened….the end of the “posses.”

    And, I think this lawyer understands this as well. Hence, his frustration with Arpaio and his reason for telling Arpaio to stop.

    IANAL so I’m speaking out of my backside here, but my impression is that forging documents and sticking them on a web site is not a crime in the US in and of itself. It only becomes a crime if you file them or use them to defraud people out of money.

    We do distinguish between “faux” (forging false docs) and “usage de faux” (actually using them for whatever purposes), but both are at least “délits” (misdemeanors), possibly worse depending on circumstances.

    Since she has publicly confessed, repeatedly, were she here, it would be routine for a local prosecutor to drag her in front of a “tribunal correctionnel,” a first instance/lower criminal court for misdemeanors and the likes. Her best defense would be to plead that she made it all up. That would be amusing.

    I’ve told Mike Volin. I’ve called Arpaio’s office and told them. I’ve posted it everywhere imaginable.

    I’ve written posts on “Before It’s News.”

    I have, most recently, told it to several deputies from the Hillsborough County Sheriff’s office who practically ran off of my porch in the other direction while I was still talking to them about the birth certificate and how it came to be.

    I’ve told Osceola County who took the three PC chips I gave them.

    I’ve called Hendry County (Mike ZulloMoore’s REAL office).

    I’ve posted on FaceBook, Twitter, and every social media/blog possible.

    I’ve called Congress.

    I’ve called representatives (FL).

    I posted on America’s Most Wanted site and several others of its kind.

    I’ve talked to this Mark McDaniel character for over two years now (who didn’t make a move until I said to him, “Maybe it’s YOU who’s under investigation.”) McDaniels then made a fake call to Hillsborough County hence the five plus deputies who showed up at my door a few weeks ago as well as a threatening YouTube video for me and Doc, deleted after one day).

    I’ve sent an affidavit to the FBI (they’re not investigating).

    I’ve called and confessed to the FBI and that one’s on YouTube here:

    I don’t know if forging a birth certificate is a felony or not in the US, but clearly no real forger (of anything really) go bragging about it to the four corners. Assuming NRO is not a troll (still a possibility) she is so obviously and transparently lying that it’s clear why no law enforcement agency would ever take her seriously.

    I don’t know about the US but an weird thing here has been, with the onset of alzheimer hitting the WWII generation, we’ve had a spat of old folks showing up at police stations confessing (mostly imaginary) crimes or (that’s a doozie) wanting to snitch on Jews to the Nazi occupier.

  41. Oh no, there was fear in this deputy’s face along with a lot of sweat. I’ve spent decades in blood and gore. I know how to read people quite well. They know. Plus, my name is, or should be, in the records of Humberto Delgado as a witness(Hillsborough County Prison System) in regards to a cop getting killed here in Tampa. Like I told this deputy, and I’ll repeat it here, I gave false evidence on Humberto Delgado (Medellin Cartel member).

    I’ve lost track of how many law enforcement officers have been killed this year. I’m sure they know. *tongue in cheek* Killing cops is Ok as long as it’s done, or ordered, by another cop as it was in this case.

Y’know, kind of like the end of that Star Trek episode when “Lazarus” and “Anti-Lazarus” from parallel universes were zapped by Captain Kirk into the corridor between their universes (in order to save both universes), to spend all of eternity at each other’s throats?

    Surely, this arrangement sucked for Lazarus and Anti-Lazarus, but for the rest of humanity it was some much-needed peace and quiet.

  49. I made my first “ripper” kill when I was 8 or 9. I modified my first file when I was age 50 or so. Some things just come easier when you’ve been doing it for so long.

    Lupin: I don’t know about the US but an weird thing here has been, with the onset of alzheimer hitting the WWII generation, we’ve had a spat of old folks showing up at police stations confessing (mostly imaginary) crimes or (that’s a doozie) wanting to snitch on Jews to the Nazi occupier.


    Good grief, I hadn’t heard about that.

    It’s no fiction.The last time Nancy did a killer rip was after an extended visit to a Korean restaurant. When she let one rip, dogs howled, babies cried, and her husband exclaimed, “For God’s sake, Nancy, next time go easy on the kim chee!”

    If I ever get to the point of only being able to relive my childhood I know they will be mostly happy memories. So very sorry for these folks of whom you speak.
